all right good evening everyone and 00:22 welcome to our 00:24 second meeting of november and 00:27 let's get the show on the road 00:31 good evening and welcome to the regular 00:32 meeting of the council of the city of 00:33 long beach held tuesday november 17th 00:35 2020 at 7 p.m 00:37 we have a roll call council member 00:39 delorey president 00:40 councilmember mandel listen 00:42 councilmember trusted 00:44 president vice president mcginnis is 00:46 absent 00:47 president bendo president let the record 00:50 indicate the presence of city manager 00:51 donald gaiden and deputy corporation 00:53 counsel richard barrios we'll have a 00:54 salute to the flag 00:56 mr barrios would you please lead us 00:58 absolutely 01:02 i pledge allegiance to the flag of the 01:04 united states of america 01:06 to the republic of the stands one nation 01:10 under god 01:21 okay thank you um just for everyone's 01:24 information uh councilwoman mcginnis 01:29 had a um had an unexpected death of a 01:32 very close friend 01:34 um so she's um 01:38 she's attending to that tonight and 01:39 that's why she's not joining us 01:42 so um she just wanted people to know 01:46 uh okay so why don't we start 01:49 with the uh city managers report 01:55 thank you um good evening everyone um 01:58 the first speaker we will have is mr 02:00 robert spalzino 02:02 to give us an update on the haberman 02:04 case 02:06 mr spolzino i'm here 02:10 good evening uh president vendo members 02:13 of the council 02:14 city manager um as you 02:18 may have heard uh the haberman case is 02:21 on trial 02:23 uh can can you all hear me 02:27 yes we can oh okay good yes okay so the 02:30 haberman case is on trial 02:32 uh before justice jack libert in the 02:35 supreme court nassau county 02:37 we started about two weeks ago we 02:43 are likely to finish tomorrow possibly 02:45 go over to friday 02:48 you have heard uh i know you've heard 02:51 some 02:52 stories about what mr haberman's claims 02:54 are in terms of damages 02:56 we're in the process of presenting 02:58 evidence which 03:00 shows that in our opinion his damages 03:04 are 03:05 far less than that if he has any damages 03:08 at all 03:09 i don't think it's appropriate for me to 03:10 talk about our strategy or what our 03:12 plans are at this moment 03:15 but once we finish the trial we will be 03:18 submitting 03:19 a post-trial brief to the judge the 03:21 judge will establish that schedule 03:24 and we will lay out our arguments in 03:26 full in that post-trial brief 03:29 and you will have the opportunity then 03:32 everyone will have the opportunity to 03:34 see uh what our position is what the 03:36 city's position is 03:38 and why we think that the 03:42 plaintiffs will not recover what they 03:45 think they're gonna recover 03:52 okay uh bob just for the edification of 03:56 some people that may not 03:57 uh know some of the history could you 03:59 just give a very high level overview of 04:02 what what brought us to this point the 04:04 case itself 04:06 sure so uh in 04:10 1987 uh 04:13 this property concerns property on the 04:15 boardwalk um 04:18 in 1987 there was a proposal to build on 04:20 this property 04:22 the um the city council at the time 04:25 decided to change the zoning and reduce 04:26 the density on the property 04:28 mr haberman sued there was a settlement 04:32 in 1989 04:34 which allowed mr haverman to build 04:37 four buildings on this property three of 04:40 which would be ten stories high 04:42 and one of which would be seven stories 04:44 high 04:45 um the 04:49 mr hebron built one building it was it's 04:52 a co-op 04:53 this this project was originally called 04:56 seapoint towers 04:58 it was and one building was built is 05:01 owned by xander corp it's now a co-op 05:04 in 2003 mr haberman proposed to build 05:08 the second of those 05:10 buildings and at that time the zoning 05:13 board 05:15 decided oh well mr haberman applied for 05:18 and received a permit to drive piles and 05:20 install 05:20 footings the folks from xander appealed 05:22 that 05:23 permit to the zoning board of appeals 05:26 which revoked that permit 05:28 largely because the largely if not 05:31 exclusively 05:33 because the uh there were time limits in 05:37 the original stipulation 05:38 variants that had been extended by the 05:41 corporation council at the time mr unger 05:44 and the zoning board did not recognize 05:46 the validity of that 05:48 uh that extension they felt that it had 05:51 have to 05:51 have their approval in order to be 05:53 extended the matter went to court the 05:55 judge held that 05:56 uh uh that the zoning board was right 05:59 the appellate division held the zoning 06:00 board was right 06:02 and then the court of appeals new york's 06:03 highest court said that mr did have the 06:05 authority 06:06 without the approval of the zoning board 06:08 to extend that time 06:11 um the the matter then went back to the 06:15 trial court 06:16 uh there was another potential 06:18 settlement that was reached 06:20 after mediation uh a year or so later 06:23 the council decided 06:24 that uh it it did not want to 06:28 adhere to that settlement there was some 06:30 question as to whether the council had 06:31 approved it or not 06:33 uh at that point 06:36 the the city withdrew from the 06:39 settlement the city had been required to 06:40 provide an answer 06:41 but didn't provide an answer and 06:43 defaulted 06:44 in the litigation uh the city appealed 06:48 that determination 06:49 the appellate division um uh firmed and 06:53 held the city in default 06:54 matter hasn't gone to the court of 06:56 appeals yet it still could 06:58 uh so the matter came back for trial 07:01 and we have been uh due to a number of 07:04 delays 07:04 having to do with the neighboring 07:06 property and the litigation involving 07:08 xander and haverham and this matter was 07:09 delayed and then because of covid the 07:11 trial was delayed 07:13 and so that has brought us where we are 07:15 today 07:16 which is where we are trying only 07:18 damages what damages 07:20 um hey roone and bel air building his 07:22 company are entitled to 07:24 because uh the city has been held in 07:27 default 07:27 and therefore liability is admitted 07:35 okay thank you um do any of the council 07:39 members have any questions 07:46 okay uh so hearing none uh bob thank you 07:49 um we'll keep our we'll keep our fingers 07:52 crossed 07:53 okay and uh hopefully you're coming back 07:56 with good news 07:57 okay i'm doing everything we're doing 07:59 everything we can to do that for you 08:01 okay thank you thank you and have a good 08:04 night 08:04 bye thank you um 08:08 next would be monique powell the 08:10 community development 08:12 director of community and development 08:18 good evening everyone uh so 08:21 i am here just to talk about one of the 08:23 projects that we have 08:25 that has been identified as a need for 08:27 the community 08:28 um is called learning spaces so with the 08:31 learning spaces 08:33 is where a collaboration with the city 08:36 and the school district were actually 08:39 providing 08:40 a safe supervised place a location 08:44 for children to learn while they do 08:47 their hybrid learning 08:48 remotely it provides developing 08:50 appropriate activities for them 08:53 and just a safe alternative instead of 08:55 them being home unsupervised 08:57 um a lot with maybe lack of 09:00 internet wi-fi or you know someone to 09:03 check their work 09:04 um and to make sure that they're 09:06 learning so uh 09:08 with the collaboration the school 09:09 district there was a survey that sent 09:11 out 09:11 that was sent out during the shutdown um 09:14 it was closed november 12th from that we 09:16 were able to 09:17 gather the data of how many families are 09:20 in need 09:21 of this service and we front loaded a 09:24 lot of information 09:25 that there's no transportation there is 09:27 food and we gave possible locations 09:29 and a possible schedule um and with that 09:32 we had about 09:33 47 responses uh put obviously um 09:36 predominantly middle school and high 09:38 school because of the hybrid schedule 09:39 that they offered 09:40 um and a lot of them was a lot from the 09:42 50 they were interested in that service 09:44 so we were able to gather 09:45 how many uh we're looking to service 09:48 that and when we say 09:48 50 that is not 50 in one day is based on 09:51 their hybrid schedule so it's an average 09:53 of 25 students per day 09:55 since we gather that data we close the 09:58 survey just so that we can make sure we 09:59 have those measurements of 10:01 uh providing services for those through 10:03 a first initial interest 10:05 uh keeping in mind a project like this 10:07 takes a lot of staffing and guidelines 10:10 um and also to adhere to covet and 10:12 operating we have to keep it under 10:14 the set amount including staffing that 10:16 needs to be um 10:18 so with that we have identified a 10:20 location 10:21 for it that has met the need because a 10:24 lot of 10:24 the family said that they are okay with 10:26 that site and it will be the magnolia 10:28 second floor 10:30 um and the good thing about that is that 10:33 it it's a great 10:34 central location it's all access to all 10:37 um 10:37 and it's a great facility that the city 10:39 owns that we will be using it has great 10:41 space 10:42 uh so again the transportation will not 10:44 be provided 10:45 food would be the staffing so we wanted 10:48 to make sure the staffing there will be 10:50 appropriately vetted to supervise kids 10:52 uh we i have met with 10:54 the youth and family staff some of them 10:57 are active uh from full-time staff that 11:01 are already at the west end community 11:03 center 11:03 uh kind of creating a staff and model 11:06 where we can use 11:07 them the days where they're not in the 11:08 programming and some of them are the 11:10 inactive staff that was recently listed 11:12 as inactive 11:13 but we are working on bringing them back 11:15 as long as it's to cover 11:17 you know the needs of the program uh and 11:19 so it creates a 11:21 job creation or retention for both the 11:23 staff that are currently at the program 11:25 that has lost enrollment 11:27 which is the sandbox am pm because of 11:29 covid 11:30 uh and the related issues but also the 11:33 creation of jobs for the supervision 11:35 and when i say supervision we are 11:37 following the ocfs state regulations 11:39 of 1 to 10 ratio um as far as 11:42 supervision 11:43 and it can go from one to twelve one to 11:45 fifteen depending on the ages 11:47 uh especially being that we are at 11:48 middle school and high school age uh 11:50 limit so it definitely matters of the 11:52 supervision and also 11:54 uh for covid as far as having staffing 11:56 on site 11:57 uh for health checks uh in daily 11:59 communication 12:00 um when it comes to the health and 12:02 safety of this program uh we will be 12:04 working simultaneously with what the 12:06 school district already have 12:08 and the policies and obviously our own 12:10 city policies when it comes to 12:12 using our state sit on sites on-site 12:15 safety plans um 12:16 as well as some covert regulations and 12:18 guidelines um the kids will be grouped 12:20 according to their grade level 12:22 again grouped together and not being 12:24 able to uh co-mingle 12:26 um but also make sure that they're doing 12:28 work lunch will be provided so they will 12:30 stop doing for lunch period 12:32 um we will have frequent communication 12:34 with the school district 12:36 about their checks their attendance um 12:38 keep in mind that staff according to the 12:40 state and ocfs regulations are not 12:42 providing instruction 12:43 they are just there as supervision to 12:45 make sure that the kids are 12:47 uh working and attentive um and that 12:50 that is really about it kids will arrive 12:52 the temperatures will be checked 12:54 attendance will be taken 12:55 they will do their remote learning and 12:56 they will be dismissed 12:58 following their their schedule their 13:00 school schedule so i know middle school 13:01 and high school varies 13:03 um and that is the goal uh we have a 13:05 launch date depending on 13:07 the collaboration um and we have a 13:09 launch date really soon 13:15 okay that sounds uh sounds really good 13:18 especially uh kids got somewhere to go 13:21 then uh 13:22 to help what they're learning uh do we 13:24 have any questions from any of the 13:26 council members 13:30 okay hearing none thank you monique 13:33 okay the um the next person i asked to 13:36 speak 13:36 um was john mooney the president of csea 13:40 um because there's lots of rumors out 13:43 there that 13:44 when we had our layoff um 13:47 right before covet and right right when 13:49 covet hit we had a layoff and then we 13:51 had another 13:52 layoff of csea employees 13:56 um and i want john to reiterate that 13:59 as people leave the city and the 14:02 position is 14:03 open that we are bringing people back 14:06 and so i just want to um dispel that 14:09 that rumor 14:10 uh mr mooney 14:13 i don't have him signed on at this time 14:19 okay i'll i'll text him so i uh i'll ask 14:22 him to come back 14:23 but yes there are people that in fact 14:26 were laid off 14:28 um and again several of the people are 14:31 already back to work 14:32 they're just in different positions um 14:35 at different salaries i see he just 14:37 popped on 14:38 he just popped on and i said john you 14:40 can unmute yourself 14:51 john you need to unm unmute 14:57 now you're unmuted 15:03 john you're on music go ahead 15:14 john if you're talking we're not hearing 15:24 you 15:27 okay well the next speaker is going to 15:29 be mr mcnally until 15:31 we can get mr mooney i just text him and 15:34 let him know that we couldn't hear him 15:38 okay well um can everybody hear me okay 15:41 yes okay so the city manager asked me to 15:44 touch upon 15:45 a few issues as part of the update this 15:47 evening 15:48 uh i'm gonna start with heavy and then 15:50 go to some happier 15:52 or lighter news um first and foremost 15:55 is just a quick update on where we stand 15:57 with covid 15:58 new numbers just came in that account 16:00 for yesterday 16:02 so the seven day period ending yesterday 16:04 saw 57 16:06 new positive cases in the long beach 16:09 community 16:10 that's averaging that's an average of 16:12 eight a day over that seven day period 16:15 uh for frame of reference back 16:18 when we were starting to hit the peak or 16:20 starting to peak in the spring 16:22 uh so march april may we were 16:26 averaging somewhere you know anywhere 16:28 between 100 150 to 200 cases 16:31 over that seven day period so we're not 16:34 there 16:34 yet but and we would like to avoid 16:38 getting there 16:39 but we're at a stage now we're at a 16:41 today 57 over the past seven day period 16:44 that's marketably increased over where 16:46 we were over the summer 16:48 and even last several weeks so we have a 16:51 level of concern 16:52 obviously the governor has issued new 16:54 executive orders 16:56 uh that all places that have a state 16:58 liquor license need to close by 10 pm 17:01 and also in-person 17:04 private gatherings at private residences 17:08 need to be capped at 10. uh our guess 17:11 internally is we'll see where we're at 17:14 uh 17:14 two weeks after thanksgiving and how 17:17 well everybody adheres to that 17:19 so in the interim we are obviously 17:22 asking everybody to re-up their 17:24 diligence the the numbers are 17:26 increasing in our community we're not 17:28 yet at a spike we want to avoid a spike 17:31 so wear your masks maintain social 17:33 distancing 17:34 and wash your hands often 17:38 and go back to where we were in the 17:39 spring so that we don't get back to 17:41 where we were in the spring 17:45 on a semi-related note well any 17:47 questions on 17:48 covid numbers 17:53 just uh you know going back 17:56 uh let's say a month or so we were 18:00 like you said the number was 18:01 significantly lower we were like one a 18:03 day right 18:04 we've so throughout the summer we 18:06 averaged you know so these are averages 18:08 but it was 18:08 half a reported case a day to a case a 18:11 day 18:12 somewhere around five weeks ago it 18:13 started ticking up to 18:15 you know we we we surpassed the one 18:17 number and then into two and then it's 18:19 really been for the past three weeks or 18:21 so we've seen three four five six and 18:23 uh the numbers that came out today that 18:25 were inclusive of 18:26 the seven day period ending yesterday 18:28 were the first time that we've gotten to 18:30 eight yeah and when i checked the 18:34 uh the map today long beaches uh 18:37 got the distinction of being higher than 18:39 most of the communities around us 18:42 yeah and that is i mean the number that 18:44 you're seeing on a news day map or even 18:45 the the county map 18:46 is is a cumulative number so it's from 18:49 the beginning of the pandemic 18:50 we as a as a zip code with 18:54 34 000 plus residents have a denser 18:57 population here so our number 18:59 just from a proportional standpoint is 19:01 going to be higher we we do not 19:03 have access to percent positivity rates 19:06 you know that the 19:07 the state really uses um so the numbers 19:10 you know we know increasing is also our 19:12 testing rather has also increased but 19:15 what we're seeing we are we are assured 19:19 that what we are seeing is not just a 19:22 response to increased testing that you 19:24 know the increased numbers that we're 19:25 seeing are 19:26 are a real increase in in in positive 19:29 tests in our community 19:31 yeah so folks please wear this 19:35 wear one of these we don't want to have 19:37 to go back to shutting things down 19:40 and it's not going to be us but the 19:41 governor that'll do it but 19:43 let's not give him a reason so please 19:48 so that was actually a perfect segue we 19:51 are starting to get calls about what's 19:52 happening with holiday events 19:54 um similar to how we've been doing 19:57 other events where we've kept things to 20:00 a 20:00 very small private crowd the menorah 20:04 lighting and the christmas tree 20:06 lighting will be largely virtual uh in 20:08 nature we're not 20:10 obviously inviting huge crowds to come 20:12 down so it'll be a very limited number 20:14 of people 20:15 really just you know the folks that are 20:16 necessary in order to make the event go 20:18 off 20:19 and we will facebook live stream uh 20:21 those events we're working with rabbi 20:23 goodman and others in the community 20:25 uh about how to make it most meaningful 20:27 from the menorah lighting and we'll do 20:29 the same for sure obviously when it 20:30 comes to the christmas tree lighting 20:32 but those will be virtual events uh the 20:35 other one 20:36 that uh we're starting to get lots of 20:39 questions on and it is painful to say 20:41 but 20:41 uh i would imagine somewhat expected as 20:44 well is the electric light parade 20:46 uh is cancelled for this year uh it is 20:50 i'm sure everybody on this zoom call and 20:52 everybody listening one of our 20:54 favorite events um but there's there's 20:56 not been a parade 20:58 held you know of of this nature held in 21:01 new york state 21:02 since really memorial day uh and the 21:04 restriction is 21:05 you can't have more than 50 people at an 21:08 event 21:09 and that includes not just participants 21:11 but spectators and there's 21:13 there's no way to hold a parade of this 21:16 nature 21:16 and contain it to just 50 participants 21:19 and spectators 21:21 um so it's regrettable it's 21:24 unfortunate it's another 2020 sort of 21:27 thing but 21:28 uh we look forward to coming back um 21:31 bigger and better in 2021 but it's just 21:33 an 21:33 impossibility to to have the electric 21:35 light parade 21:36 um you know in during these times and 21:40 uh with the numbers going the direction 21:42 that they're going in um you know and 21:44 that's really 21:45 from uh if we did try and pull it off 21:47 then we run into the wrath of 21:49 potentially having 21:50 you know a turning into a super spreader 21:52 event potentially but then also b 21:54 the governor coming in and saying well 21:56 long beach isn't following the rules so 21:58 we're just going to shut it down and 22:00 neither of those 22:01 uh probable outcomes are what we want to 22:05 see 22:06 so um unfortunately we're passed for 22:08 this year 22:09 but we look forward to 2020 being or 22:11 2021 22:12 being vastly different than 2020 22:16 questions on those items 22:21 no what's the happy news uh we're 22:24 getting better now so this is 22:26 this is all slightly better stuff moving 22:27 forward um 22:29 on the agenda tonight are uh it's really 22:32 with agenda items number eight and nine 22:36 concern what's been going on with our 22:38 rec center and our programs and the 22:40 outside vendors so 22:42 um i just wanted to be able to give or 22:44 the city manager asked me to give a 22:45 little bit of a recap to how we got to 22:47 where we are tonight 22:49 um i've spoken with i don't know how 22:51 many understandably concerned parents 22:53 over the past three weeks 22:55 uh obviously not an ideal situation that 22:57 we find ourselves in but 22:59 and i've spoken with many council 23:00 members over it but just wanted to give 23:02 as quickly as i can a 23:04 sort of re-account of of how we got 23:06 where we are 23:07 so the last weekend in october uh one of 23:10 the city organized programs 23:12 had a positive covent test uh with 23:16 one of the player or one of the coaches 23:18 so 23:19 we had to sort of double down and figure 23:21 out what we were doing 23:22 in terms of protocol not in terms of 23:26 that the sport was not being carried out 23:28 the right way but 23:30 how we would manage shutdowns when we 23:32 got a positive case so 23:33 we shut down programs for the weekend 23:36 reviewed those protocols 23:37 had them in place but as part of that 23:39 process we also looked at 23:41 the agreements that we had with all of 23:43 the third party vendors that were 23:45 operating 23:46 uh our youth program so whether that was 23:48 in the the ice arena or whether that was 23:51 in the pool 23:52 um and even some other extracurricular 23:54 activities we needed to make sure that 23:56 we had the proper liabilities in place 23:59 and that the agreements were up to snuff 24:01 and as the council is well aware um 24:05 our city has had a history of doing 24:08 business 24:09 in a very informal way and often via 24:12 handshake agreements 24:13 um the the prior was probably the case 24:16 here 24:17 um we we very much like 24:20 all of the outside organizations that 24:23 are operating our programs they are 24:25 bedrocks of our community whether it's 24:28 you know the 24:28 the lightning the sharks whether it was 24:30 scoot and surf whether it was lyack 24:33 you know this is not a reflection on the 24:35 quality of any of the programs or any of 24:37 the vendors 24:38 but at the end of the day when we took a 24:42 glimpse at 24:43 what those agreements look like there 24:45 was no 24:46 indemnification for the city and the 34 24:50 000 residents that represent the city so 24:52 you know hockey can be a very physical 24:54 sport swimming has its 24:56 dangers side to it and all of our 24:58 vendors do a fantastic job 25:00 but if somebody got hurt the exposure to 25:03 our taxpayers 25:04 was just untenable so we needed 25:07 formalized agreements to be put in place 25:09 that passed muster 25:10 and that made sure that everybody was on 25:13 firm footing both in terms of the third 25:15 party vendor 25:16 the residents um you know and the city 25:18 proper 25:20 and in addition to that along the same 25:22 theme 25:23 there's obviously a good deal of money 25:25 that changes hands as part of these 25:27 arrangements 25:28 just between families and the third 25:30 party vendor 25:32 uh the vendor and the city how they 25:34 lease out space or whatever agreement we 25:36 have 25:37 and to a you know really to 25:40 a party all of those arrangements 25:44 had not gone through a proper 25:46 procurement 25:47 uh procedure for however many years 25:52 um so we felt we really needed to in 25:55 order to get to the place where we could 25:56 sign 25:57 a valid tight protective agreement that 26:00 everybody could live with and that you 26:02 know these programs could flourish under 26:04 we needed to go out for an rfp and that 26:07 meant 26:08 that there was gonna have to you know 26:10 even after 26:11 the pause for kovid that we were gonna 26:13 have to keep people 26:14 off ice and these programs on pause for 26:17 a few weeks until 26:18 that got fleshed out so as soon as we 26:21 came to that 26:22 internal conclusion uh an rfp was issued 26:25 uh and we fast-tracked it you know to 26:28 what the the minimum legal time was so 26:30 we got the responses back from almost 26:31 all the vendors that were previously 26:33 operating 26:34 uh and we went through the internal 26:37 evaluation committee and what you see 26:39 tonight on 26:40 agenda item eight um are 26:44 they almost all of the previous outside 26:46 vendors 26:47 that were operating there are back at 26:49 the table and will be pending for your 26:51 consideration tonight 26:53 uh conditional approval that would get 26:56 them 26:57 um operating as early as tomorrow um 27:00 while we work out finalized agreements 27:01 with them 27:04 so that was a little bit more 27:05 complicated but um any questions on that 27:13 okay moving on the last bit of news i 27:16 have 27:16 is that this sunday from 9 00 a.m until 27:20 1pm uh behind the long island railroad 27:24 parking garage where we typically 27:26 do the annual stop program and where the 27:28 stop program was held just 27:30 two weekends ago i believe we are doing 27:32 our first uh 27:34 community shred slash e-cycle day 27:38 so e-cycling is something that we had 27:40 previously had a bin 27:41 set up uh behind the rec center that 27:44 location got 27:45 moved due to covid it will be coming 27:47 back in a couple of weeks but we assume 27:49 we have a pent-up demand for e-cycling 27:52 so we have the vendor coming with a 27:54 whole bunch of you know flatbeds 27:56 to accept large items and any cycling 27:59 items 28:00 and i don't believe it's ever been done 28:02 in the city before but this was a 28:03 brainchild of our city manager it's been 28:06 it's happened in other areas where where 28:08 she has worked 28:09 but a community-wide shred day so we 28:11 will have a shred truck 28:13 this is for long beach residents only 28:15 we're going to ask people to bring valid 28:16 ids 28:17 9 a.m to 11 a.m this sunday morning 28:21 our facebook page and website will have 28:23 updated 28:24 more detailed information about it 28:26 tomorrow morning 28:27 but we're excited to have a service that 28:30 we know is uh 28:31 there's a high demand for and we look 28:33 forward to this being an annual event 28:36 that's the end of it for me 28:39 so john in addition for the shred it's 28:42 is it just 28:44 documents just paper or is it 28:48 other things like cds and things like 28:51 that that you know people may have old 28:52 cds with files on them and stuff 28:54 no for the shred it's really it's paper 28:56 products you know and it can't be in 28:58 plastic binders 28:59 staples are okay but binder clips are 29:01 not um all of those details will be on 29:03 the flyers on the website that start 29:05 going out tomorrow 29:06 okay and we're just asking no more than 29:09 three boxes per car load for uh 29:11 for the shred so might not be everything 29:14 in your basement but we're happy to take 29:15 a chunk of it away 29:17 does that include a refrigerator box 29:21 if you can fit it in your car maybe 29:25 all right uh any questions from the 29:29 council members 29:30 you said it so it'll be shredding and it 29:32 will be 29:33 electronics as well correct we'll have 29:36 we'll have two separate lines 29:38 you know provided that demand is there 29:39 this is the first time we're doing it so 29:41 we're going to see 29:42 um but provided that demand is there 29:44 we'll have two separate lines one for 29:45 shredding one for recycling if somebody 29:47 has both we'll have staff on the ground 29:49 too 29:50 um we'll probably send you on the 29:51 e-cycle line and then we'll have staff 29:53 on the ground 29:54 to help move your your paper goods and 29:57 your shredded items 29:59 from the e-cycling side over to the 30:00 shredder what i would say because of 30:03 covid 30:04 this is not a stand and watch your 30:07 your documents get shredded it's going 30:08 to be dropped off we promise you we will 30:11 shred it we don't want to look at your 30:12 stuff the whole point of this is to help 30:14 you eliminate 30:15 um confidential information it will 30:17 grant shredded but there's not going to 30:19 be 30:20 an opportunity for folks to sit and 30:22 watch their individual boxes get 30:24 shredded but we have a reputable company 30:25 that's doing this that 30:27 will guarantee that the documents are 30:28 shredded and disposed of properly 30:33 um thank you mr mcnally 30:37 liz are you finished i was just saying 30:39 thank you mike go ahead 30:40 okay um 30:44 when you drive up with a box or two in 30:46 your 30:47 trunk is the staff able to help 30:51 carry that box to the shredding machine 30:55 yes that's what we're going to be having 30:57 staff on site for i mean i ideally the 30:59 way this works especially in covid is 31:01 you have it in a trunk um we're 31:04 obviously trying to limit contact so you 31:05 have it in your trunk you pop the trunk 31:08 we pull it out of the trunk and you're 31:09 on your way and 31:12 i would assume that people that are 31:15 driving 31:15 to this event should be wearing their 31:18 masks 31:20 absolutely thank you for that if you 31:21 didn't hear my first item update 31:23 please wear your masks that goes for all 31:25 such activities 31:26 by the way i asked because i attended 31:28 the town of hampstead one a couple of 31:29 weeks ago 31:30 and i watch their procedure 31:33 and they're 31:37 it's very good the last question i have 31:40 is 31:42 are business owners allowed to do the 31:45 same 31:46 or is it just residents uh if the 31:48 business owner is a resident 31:50 yes okay thank you 31:56 okay did we ever get mr 32:00 i guess we're done here uh with this one 32:02 you all done john 32:05 i think you've heard enough of me for 32:07 one night 32:09 did we get mr mooney back there's no 32:11 there's no steelers game tonight to 32:13 distract them so 32:15 i see he's back so let's see he's back 32:18 let's see if we can hear him this time 32:20 you hear me now we can hear you okay 32:25 all right just to point out what uh the 32:28 steelers are 9-0 by the way just want to 32:30 remind mr bendo that 32:32 um since the pandemic and the layoffs 32:34 and the budget 32:35 i've worked very hard with the city 32:37 manager uh we've brought back some of 32:39 the employees when either a vacancy 32:40 existed 32:42 or retirement happened um jobs were 32:45 offered to some 32:46 employees they refused them others 32:48 accepted 32:49 and we've moved on in a good direction 32:51 the city managers worked in good faith 32:53 with us 32:54 and i want to personally thank her for 32:55 that we still have more work to do on 32:57 that and we're going to do it and get it 32:59 done 33:00 um and i would ask that people not pay 33:02 attention to all the trolls 33:04 with the fake identities on social media 33:07 there are no new layoffs due to anything 33:08 on this agenda tonight 33:10 and we're working with the city we've 33:12 been working with the city and do not 33:13 pay attention to the trolls 33:15 with the fake identities on social media 33:17 all jobs clear and easy 33:19 work as hard as we can for our residents 33:20 and produce the best product we can 33:22 it's that simple and to touch on what uh 33:26 mr mcnally spoke on before 33:28 we've been promoting to mask up social 33:30 distance and keep getting tested and 33:32 let's beat the virus together 33:34 so has anybody got any questions for me 33:40 this is liz i just wanted to say thank 33:42 you and thank everyone for their 33:44 services to our city 33:46 no problem thank you too we'll get 33:47 through this 33:49 um thank you mr mooney um i just want to 33:52 say thank you i enjoy working with you 33:54 as well um we are trying to work 33:56 together moving the city 33:58 forward and then the ones that are uh 34:01 still laid off as we have more 34:03 retirements which we are anticipating 34:05 happening 34:06 in the next two months we can offer uh 34:08 people that were 34:09 laid off and a job and the goal is to 34:12 bring back as many as we can 34:14 um and we are staying within budget so i 34:17 i really appreciate you the only the 34:20 last thing i have 34:21 is that the boards are up 34:24 we have uh last night we had the very 34:28 first introductory meeting for the 34:30 senior advisory board um where the 34:33 board members got a chance to meet each 34:35 other tomorrow night it will be the 34:37 planning 34:38 the planning board um we have a 34:41 recreation 34:42 boards and uh board that will be meeting 34:44 soon 34:45 um and then we have the environmental 34:47 board 34:48 one of the resolutions on tonight is to 34:51 add numbers to the 34:54 environmental we actually have more 34:56 people that want to be involved 34:59 on the environmental than the charter 35:01 says 35:02 and we believe that increasing the 35:04 number will benefit the community 35:06 we have some really dynamic people um 35:09 what is really exciting is that we have 35:12 long time residents and we have new 35:14 residents 35:16 so everyone's coming together we're 35:19 still looking for people for public 35:21 safety 35:22 ethics and zoning so if you are on the 35:25 board 35:26 currently on the board please resubmit 35:28 an application 35:30 or if you if you have not submitted an 35:32 application stating that if your term is 35:34 up that you would like to remain on the 35:36 board 35:36 um because we would like to get those 35:38 boards filled and get those 35:39 up and running as soon as possible as 35:42 well 35:43 uh civil service um you will be getting 35:45 the names 35:46 for the people that we are moving 35:48 forward to civil service 35:50 to be on the agenda for the december 1st 35:53 and so uh what all i can say is that the 35:56 residents that are on these boards and 35:58 commissions are very happy 36:00 that they're back up and running and 36:02 they can give back to the community 36:04 so that ends my report yeah i also i 36:08 think it's worth 36:09 noting that you know so we had talked 36:12 about 36:13 uh back in earlier in the year that we 36:15 were going to start standing up these 36:17 boards and commissions again 36:18 unfortunately covid slowed things down 36:21 because meetings 36:22 couldn't take place and we hadn't quite 36:25 worked out this whole zoom thing at uh 36:28 yet so that kind of put a hinder but you 36:30 know as you can see we're we're getting 36:32 these 36:32 these long dormant or 36:36 quite frankly boards that existed on 36:38 paper but didn't exist in reality 36:42 up and running but i think it's 36:43 important to note too that 36:46 it wasn't just people were appointed the 36:49 city manager 36:50 actually interviewed every one of the 36:53 people 36:54 that's been appointed they all went 36:56 through an interview process 36:58 so uh this wasn't just you know somebody 37:02 sent an email saying i want to be on uh 37:04 it wasn't that simple the everybody was 37:07 interviewed and their qualifications 37:09 reviewed 37:10 to make sure uh people were were a good 37:12 fit and 37:13 weren't necessarily coming with uh um 37:17 agendas quite frankly i'll put it that 37:21 way 37:22 so uh i i i wanted to give kudos to the 37:25 city manager 37:26 for making sure this was a thorough uh 37:29 thorough process 37:32 um thank you i also want to mention to 37:34 everyone all our meetings are by 37:36 zoom so we're not meeting in person 37:39 everything is zoomed yeah and if you 37:41 want to join if any residents want to 37:44 join but don't want to come in for an 37:46 interview 37:46 i do zoom interviews as well 37:50 okay good to know 37:54 all right uh any of the council members 37:57 got any questions for donna before we 37:58 move on 38:01 all right see you none so dave why don't 38:03 we move on to the 38:04 to the agenda okay i'm going to call the 38:07 public hearings out of order 38:08 um we're going to start with the off 38:10 street so 38:11 our first public hearing is going to be 38:13 the resolution granting waiver of war 38:14 street parking requirements for premise 38:16 126 east park avenue street floor for a 38:19 gym studio 38:20 and we do have the owner on i'm gonna 38:23 allow you to talk 38:27 okay kelly you're unmuted yeah can you 38:30 hear me yes we can hear you great 38:32 hi kelly hi how are you good 38:35 good so uh can you tell us a little bit 38:38 about your business 38:39 sure core 95 was actually um a business 38:42 that was across the street 38:44 uh from city hall it was a hot bar in 38:47 yoga and pilates studio so bar b-a-r-r-e 38:51 so it's exercise not a bao um so it's a 38:54 hot yoga 38:55 studio bar studio exercise studio 38:58 and um due to covet it was a shared 39:01 space 39:02 and we had to close so now we're 39:04 reopening 39:05 uh uh 126 east park 39:08 okay and that's next to uh margaritas 39:11 right 39:12 yep mm-hmm okay um 39:16 so what do you anticipate your your 39:18 hours to be 39:19 well if it's like la what our our 39:22 previous you know 39:23 it's a little hard to say with coven but 39:25 what we're hoping is 39:27 we will have a 6 a.m class an 8 a.m 39:30 class 39:31 a 9 30 class and this won't be every day 39:33 like so say monday wednesday friday 39:35 would more than likely be a 6 a.m and a 39:37 9 39:37 30 and then tuesday thursday would be a 39:41 seven 39:42 a.m and maybe a nine and then usually in 39:45 the middle of the day the studios don't 39:47 get 39:47 much um action it's usually two hour two 39:51 hours worth of classes in the morning 39:54 maybe there might be something in the 39:56 middle of the day but probably not 39:57 because 39:58 the numbers wouldn't warrant it and then 40:00 in the evening we have two classes 40:01 usually at five 40:03 and sometimes seven sometimes eight 40:06 and then on the weekend we have morning 40:09 classes so it's really in the 40:11 early morning till about 11 a.m then 40:14 there's a chunk of 40:15 time that we're not in there and then it 40:17 starts back up around 40:18 4 30 and kind of ends 40:22 around eight tuesday nights the only 40:24 time we had an eight o'clock class and 40:26 then 40:26 that class ended at 8 45. okay 40:29 great uh how many people do you 40:31 anticipate uh in 40:33 in a class or in in the facil studio at 40:36 any time 40:38 and not the numbers we used to have well 40:40 yeah obviously 40:43 hopefully i can make the rent no i'm 40:44 kidding no i would think 40:46 probably uh based on 40:49 the square footage and what we're 40:50 allowed the maximum right now 40:53 would be 20. i don't think we'll get the 40:56 maximum what i'm seeing 40:57 other gyms and other studios that are 40:59 similar to 41:00 ours is about 10 12. 41:04 in the morning we've had the early 41:06 morning classes there they've always 41:07 just been about 41:08 three to six people um so it's a 41:11 boutique fitness so the numbers 41:13 are meant to be stronger than sort of a 41:15 big box 41:16 smaller than a big box gym you know you 41:20 don't usually get higher than 20 anyway 41:21 it's supposed to be more of an intimate 41:23 setting but i 41:24 i i think it's going to be 10 to 12 i 41:26 mean that that would be my guess 41:27 all right now how many employees do you 41:29 anticipate having no 41:31 employees all of our instructors are 41:33 contractors so they contract 41:34 out they're 10.99 oh okay yeah so 41:38 i'm the only employee and then all the 41:40 instructors 41:41 okay are you still doing dance classes 41:44 too 41:45 we were you know it was they were so fun 41:48 but they did not take off to the degree 41:50 that we thought they would 41:51 um i think we'll bring them back i just 41:54 hope they work i 41:55 enjoyed them but they they wouldn't they 41:57 didn't pick up the adult dance classes 41:59 and the adult hip-hop 42:01 they just didn't pick up like we thought 42:04 they would 42:05 all right because i think councilman 42:06 mandel wants to learn how to cha-cha 42:08 we'll teach him we got you i'm in 42:12 [Laughter] 42:15 all right uh do we have any uh questions 42:17 from the uh 42:19 council members 42:22 hi kelly this is liz hey liz 42:24 congratulations 42:25 thank you um um is there room for a bike 42:30 rack outside that business 42:32 there is an existing bike rack um 42:35 right to the right of it i don't know if 42:37 it's mine or i mean the building's owned 42:39 by the same person as 42:41 margaritas so i guess it's just a shared 42:43 back bike rack but there is 42:45 there are two bike racks two orange ones 42:47 there 42:48 and i was actually thinking of asking 42:50 for another one because we actually 42:52 encourage our members to bike to the 42:55 studio and take a picture and then they 42:56 get entered into winning 42:58 raffles and stuff because we're super 43:00 i'm super eco 43:01 conscious so great yeah so i was it's in 43:04 my list of things to ask them there are 43:06 two in existence but i would love there 43:08 is room 43:09 there's this like potted plant saying 43:11 not it's not it's like a 43:13 this this there's a thing that we could 43:15 move and maybe get another one so i was 43:17 going to ask the landlord 43:18 and the city oh yes the potted plant 43:21 yeah not the permanent one there's like 43:24 this 43:26 yeah all right any other questions 43:32 okay uh thanks kelly uh dave so we don't 43:35 have to 43:36 keep her here can we uh ask if there's 43:38 any questions from the public 43:40 uh yeah why don't we uh see if there's 43:42 any questions from the public and then 43:43 we can take 43:44 once again and once again folks uh if 43:46 you want 43:47 for any of the items for public comment 43:50 please use the raise your hand function 43:52 if you have any questions and right now 43:54 i do not see any hands raised 43:57 okay great so why don't we uh move on 44:00 and uh 44:01 take the vote and that way uh we can so 44:03 this is this 44:04 this public hearing is um with item 44:07 number three on the agenda a resolution 44:08 granting waiver of all street parking 44:10 requirements for premise 126 east park 44:12 avenue for a gym studio 44:14 would you just move the adoption of this 44:15 item i will 44:19 second i will 44:23 voting council member delorey yes 44:25 councilmember mandel 44:27 yes councilmember treston yes 44:30 uh president bendo yes welcome back to 44:33 long beach and 44:34 councilman mandel is looking forward to 44:36 the cha-cha class 44:40 all right good luck and welcome back 44:43 hi kelly thanks guys appreciate it 44:46 good night bye 44:50 all right we got another public hearing 44:52 yes so we now 44:53 we have the the first public hearing 44:55 which is an ordinance to mend the code 44:56 of ordinances of the city of long beach 44:57 regarding motor vehicles and traffic 45:01 okay and who's gonna speak on that one 45:09 is that rich and uh commissioner ragona 45:17 oh i see phil popped up 45:23 hi can you hear me yes we can great hi 45:26 everybody 45:27 um in regards to this uh 45:31 this ordinance that we have about the 45:32 motor vehicle and traffic law for 45:33 commercial vehicles 45:35 um as you know we we can't have 45:38 commercial we don't have commercial 45:40 vehicles parking within the city of long 45:42 beach and there is a need to have 45:44 a allocated area to have commercial 45:46 vehicles park 45:48 over the last number of years it seems 45:51 like the area that we've now 45:53 um are allocating for vehicles 45:57 from long beach boulevard um 46:00 going down towards riverside on park 46:03 place that 46:04 one block area and ending at riverside 46:06 going one block north and south 46:08 um has been an area where many 46:12 many commercial vehicles have begun 46:15 begun to 46:15 park their their trucks their motor 46:18 homes their trailers 46:20 um it's become a bit of an eyesore and 46:23 um 46:23 kind of uncontrollable so we put our 46:25 heads together 46:27 and we decided if you're going to have 46:29 an allocated area for commercial 46:31 vehicles 46:32 it's a great commercial area but we need 46:34 to control it as a city 46:36 um and that's exactly what we're doing 46:38 with this 46:39 this ordinance uh what it will do is 46:42 it'll 46:43 put a small area where all residents 46:46 have primary um the primary option to 46:50 park their vehicles and then out of town 46:53 is also 46:54 uh commercial vehicles uh along that one 46:56 and a half block radius 46:58 um through getting permits and with the 47:01 commission will get through the city 47:02 clerk 47:03 there'll be a fee it'll it'll generate 47:05 revenue but that's not the primary um 47:07 reason we're doing it we're putting in 47:08 an area where we can now 47:10 know what cause of air what commercial 47:12 vehicles are parked 47:13 we can control it by we i mean the 47:16 police department 47:17 um and make sure that they're adhering 47:19 to the rules that they're legally 47:20 registered 47:21 and they uh they're in a commercial area 47:24 a small area 47:25 but an area that we know they're at 47:29 and that we can check and that we can um 47:32 uh make sure that the cars that are 47:33 there the commercial vehicles 47:36 um are registered with the clerk's 47:38 office and that 47:39 the vehicles are also legally registered 47:41 and insured and inspected 47:43 so i think it's a win-win for the city 47:45 and for the businesses and the business 47:47 owners 47:47 from town 47:51 so phil if somebody um 47:55 obviously there's been vehicles parking 47:57 back there now how how are we going to 47:59 let 48:00 um how are we going to get word out that 48:03 people will now have to have a permit 48:06 right so we're going to do an an 48:07 informational type of strategy 48:09 we're going to start with well when if 48:11 this passes and and it goes through 48:13 um we're going to for the next month or 48:15 so we'll start putting 48:17 warning tags on all the cars that are 48:19 there 48:20 and we'll let them know effect of the 48:22 date that we have it and january 1st is 48:24 the date that it seems to be on here 48:26 that you will start getting summonsed 48:28 and or towed if you 48:30 are not you have to permit on your car 48:33 um 48:34 so for the next month or so we will let 48:36 them know we're not just going to start 48:38 arbitrarily towing cars or summonsing 48:40 and then effective january 1st uh 48:43 we'll go we're going to uh into 48:46 enforcement mode 48:49 okay um 48:54 and and this is just this does not 48:56 include 48:58 tractor trailers and campers and things 49:01 it's it's more 49:02 smaller box truck type things and 49:05 and uh other smaller commercial vehicles 49:07 correct 49:08 yes we have a 20 foot length on on on 49:11 the vehicles that can be parked in the 49:12 commercial vehicles there's not going to 49:13 be tractor trailers there they're not 49:15 acceptable 49:16 um and it's something we discussed in 49:17 length we don't want to have a bunch of 49:19 tractor trailers parked back there 49:22 it really is meant to assist the 49:24 residents 49:25 who have a business and want to put a 49:26 commercial vehicle somewhere in town 49:28 it's a commercial area that they can put 49:30 it 49:31 um but certainly not for tractor 49:32 trailers 20 feet is the maximum length 49:34 you can have 49:36 okay uh any questions from any 49:40 of the council members um i just have 49:44 one question commissioner is 49:46 approximately how many uh 49:50 vehicles um 49:53 a certain length would be able to 49:56 fit in this area that's a great question 50:00 mr glory 50:01 and i really don't know the answer i i 50:03 would imagine this is 50:04 well over a hundred that he can fit in 50:06 that block area if they're 20 50:08 they're going to be 20 feet and under so 50:10 depending if it's a smaller trailer 50:12 and a lot or a 20-foot box truck 50:15 it would depend um but probably close to 50:18 100. 50:20 yeah i'm just thinking if if if there is 50:23 ever an overflow of people 50:26 needing a permit that we can't 50:30 fit in that location i guess we could 50:32 look into that down the road if it 50:34 happens 50:35 yeah we've actually talked about it 50:37 myself and uh 50:40 think like frasier in regards to moving 50:43 it from riverside when you get to that 50:44 block all the way down to um 50:46 ponch so we've talked about moving 50:49 another block down 50:50 and if need be and the uh 50:53 there is a requirement or the need for 50:55 it we'll do that 50:56 okay thank you very much you're welcome 51:03 all right um 51:06 any more questions from the council 51:10 all right any questions from the public 51:13 yes we do we have roy lester has his 51:15 hand up i will unmute him 51:17 okay go ahead right can you hear me 51:21 yes sir okay uh just couple of questions 51:25 the if somebody's doing work on the 51:27 house for example they have a commercial 51:29 vehicle 51:29 and they're only there for a couple of 51:31 days they still have to buy you a year 51:33 permit for the 750 dollars just to park 51:36 for the couple of days 51:40 okay um how you doing mr lester 51:45 can you hear me yeah i hear you 51:48 right i think the way this particular 51:50 provision is is contemplated it's not 51:52 meant to kind of knock 51:54 contractors who are working on a 51:55 property temporarily it's more about 51:57 um residents who have commercial 51:59 vehicles that have no place to park them 52:02 um i don't think it's we're gonna hit 52:03 every single contractor for 750. 52:06 uh i don't think that's what it's 52:07 contemplated for uh commissioner rogona 52:09 and dave you can correct me if i'm wrong 52:12 that's that's my understanding of what 52:13 the but that's 52:15 whether you're going to do it or not 52:17 that's how it's written though isn't it 52:21 only if they want to park in the 52:22 commercial zone up um 52:24 up on um park place well where else 52:27 would they park 52:28 if they're working on the house for a 52:30 couple of days 52:32 at night 52:35 it's the same as where they park at 52:37 night now that what this is intended for 52:39 more 52:40 is is long-term parking 52:44 but i mean the way it's written 52:47 i know what it's intended for and i'm 52:49 sure you don't intend to put anyone in 52:51 jail but it says you can go to jail for 52:53 15 days 52:54 if you stop at the wrong place or park 52:56 in the wrong place 52:58 i'm just asking if the way it's written 53:01 am i wrong 53:04 that if you want to park in the 53:05 commercial place 53:07 you can't park any place you can't park 53:09 a commercial vehicle 53:10 in a regular street unless you're 53:13 unloading or loading 53:14 and you have 30 minutes stuff like that 53:17 so if you're doing work on the house for 53:19 let's say three or four days and you 53:22 want to park your 53:23 vehicle in the commercial area which 53:27 which would make sense am i correct that 53:29 you would need 53:30 according to the law to pay the 750 53:34 for the application i think mr lester 53:37 what i think it's kind of 53:39 the way the way i guess it really works 53:41 in fact right so 53:42 when a when a cop is working on a house 53:45 it's not like they post up and leave 53:46 their truck there 53:47 overnight because we have uh hours of 53:50 construction under the code right 53:52 so presumably and i'm just kind of going 53:54 off your hypothetical 53:55 that a contractor does work on a house 53:58 does their work for the day 53:59 and then packs it up and goes home if 54:02 under your circumstances you're saying 54:04 let's say that contractor wants to park 54:06 overnight for 54:07 days the only place they can do so is at 54:10 that commercial parking area 54:12 and if they wanted to do that yes they 54:13 would have to purchase a permit 54:15 for 750 dollars for a couple of days all 54:18 right that's right 54:19 that's what they wanted to do um 54:21 typically yes i could 54:22 take their trucks back to wherever they 54:23 were from you know yeah 54:25 okay thank you okay 54:29 any more dave nope that's all 54:32 okay so let's uh close that hearing and 54:35 uh 54:36 we'll move on we'll go on to the onto 54:38 the regular calendar 54:39 our first item is uh item one is 54:41 approval of minutes from prior meeting 54:42 october 6 54:43 2020. we'll make a motion to approve 54:45 those minutes 54:47 i will second 54:52 anyone someone anyone i will 54:56 thank you voting council member delorey 54:59 yes councilmember mandel yes 55:01 councilmember treston 55:03 yes president bendo yes okay 55:06 item two is in order to amend the code 55:08 of ordinances the city of long beach 55:09 regarding motor vehicles and traffic a 55:11 hearing has been held on this item 55:12 already 55:13 item three we've already uh voted on as 55:15 well resolution granting waiver of war 55:16 street parking 55:17 premise 126 east park avenue for a gym 55:19 studio 55:20 i'd afford the resolution adopting an 55:22 expenditure policy for the city of long 55:24 beach 55:26 okay that's james 55:32 and ana 55:38 okay you're both unmuted good evening 55:41 good evening hi james hi iana 55:44 for giving us the opportunity to speak 55:46 again um you know the the first policy 55:48 we'd like to speak about 55:49 is the expenditure policy uh so the 55:52 expenditure policies 55:53 it's a financial policy which is 55:55 generally considered to be 55:56 a a best practice it addresses a range 56:00 of issues around how the money is 56:03 expended 56:04 including personnel outsourcing and the 56:07 funding of 56:08 certain long-term liabilities the policy 56:11 includes you know number of different 56:13 procedures 56:14 and policy statements relating to the 56:16 various uh you know various purchase 56:18 transaction types departmental 56:21 compliance 56:22 and monitoring of budgetary 56:24 appropriation lines 56:26 and how vendor invoices would be handled 56:29 it further includes time frames relating 56:31 to the term 56:32 and the lapse of those budgetary 56:33 appropriations 56:35 and there's an annual requirement in the 56:37 policy 56:38 for department heads to acknowledge that 56:40 they have received and reviewed the 56:42 city's 56:42 expenditure policy 56:48 okay any questions from the council 56:51 members 56:55 all right and this uh like i said uh at 56:58 previous meetings you're gonna see 56:59 uh more of these these policies that 57:01 we're instituting to start uh 57:04 getting some standardized practices and 57:06 uh in place 57:08 that uh across the city so 57:12 uh people know what's expected and uh 57:17 and like i said start defining how we we 57:19 conduct some of our business 57:21 um so there's three more that we're 57:23 doing tonight uh 57:25 all right i didn't see any questions 57:27 from any of the council members so 57:29 uh thanks james i'm sure we're gonna be 57:31 hearing from you 57:32 again shortly but yep i know and then uh 57:34 do we have any from the public 57:36 yes roy lester okay go ahead roy 57:44 you hear me now yes yes okay under the 57:47 expenditure policy statements number six 57:50 it says whenever reasonably possible 57:52 arrangements will be made with other 57:54 government governments private 57:56 individuals and firms to contract 57:58 out or cooperatively deliver services in 58:00 a 58:01 uh manner that reduces costs improving 58:03 fish efficiency 58:05 is this something new i know that while 58:08 i was on the school board for years we 58:10 tried to get the city to 58:12 uh operate cooperatively with us on even 58:15 the simplest things like snow removal 58:17 and stuff and we could never even get a 58:19 meeting with the city 58:20 is that has that been changed 58:24 what do you mean change roy you mean are 58:26 we going to try to do more things 58:28 collaborative 58:29 collaborative yeah yes yes yes we are to 58:32 help save money for both this 58:34 for like for the school it would help 58:35 save money for the city and the school 58:37 district 58:38 oh no kidding yeah we've been trying um 58:41 and the other thing is under number nine 58:43 it says all appropriations and operating 58:45 funds of the city shall lapse at the 58:47 close of the fiscal year to the extent 58:49 that they have not been 58:50 expended or encumbered how much over the 58:53 last two years has not been expended or 58:55 encumbered 58:57 in the appropriation roy and let you 58:59 know that's not something we have handy 59:02 readily available okay yeah 59:06 thank you thanks okay 59:09 anyone else dave 59:12 nope that was it okay so let's move on 59:17 okay item five is a resolution adopting 59:19 and americans with disabilities act 59:20 policy for the city of long beach 59:23 okay i guess that's gonna be james again 59:27 yes so the ada policy again relates to 59:31 the americans with disabilities act 59:33 it's intended to ensure that the city 59:35 does not discriminate against qualified 59:37 individuals with disabilities 59:39 with respect to the city services 59:42 programs 59:43 activities or employment with the city 59:45 there's policy statements that certify 59:47 the city 59:48 does not discriminate 59:51 on the base of disability in its hiring 59:53 practices 59:55 and that it will comply with all 59:56 applicable regulations in addition upon 59:58 request city will 60:00 generally provide appropriate aids and 60:02 services leading to 60:03 effective communication for qualified 60:06 persons with disabilities so they can 60:08 participate equally 60:09 in the city's program services and 60:10 activities when necessary 60:13 the city will make all reasonable 60:15 modifications to its policies and 60:17 programs 60:18 to ensure that people with disabilities 60:20 have an equal opportunity to enjoy 60:22 uh those program services and activities 60:25 finally the policy defines a grievance 60:28 process which may be used by anyone who 60:30 wishes to file complaint 60:32 on the basis of discrimination of their 60:35 disability 60:36 in the provision of any of those 60:37 services activities or programs 60:42 okay great any questions from any of the 60:46 council members 60:49 liz you got a big grin on your face 60:53 you know i've just only been waiting 30 60:55 years i know 60:57 what's another 25 minutes 61:00 i know um 61:04 all right any comments from the public 61:06 dave yes mr lester 61:08 okay welcome back roy doesn't anybody 61:12 else ask questions 61:16 thanks under number four modifications 61:19 to policies and procedures the 61:21 third paragraph the ada does not 61:24 require the city to take any action that 61:26 would fundamentally alter the nature of 61:28 its programs or services 61:30 or impose an undue financial 61:33 administrative burden 61:34 who decides whether it's an undue 61:36 financial administrative burden 61:38 and what is the criteria 61:46 you muted donna oh okay sorry now you're 61:48 unmuted yeah 61:49 that was deliberate yeah 61:53 no um say the question again roy 61:57 okay it says that it doesn't require the 61:59 city to take any action you know to 62:01 enforce this law 62:02 that would impose an undue financial or 62:05 administrative burden 62:08 you know so it it it just seems to me if 62:10 you they say 62:11 well you're supposed to have this for 62:13 the ada 62:14 and the city says oh we can't afford 62:16 that that's good enough 62:17 who makes that decision and what is the 62:20 criteria to make that decision 62:22 well i would say first of all um we 62:25 would do everything in our power to make 62:27 sure that we comply 62:29 if it's something that we feel that 62:32 exceeds 62:33 uh a typical expenditure that would come 62:36 back to the council 62:38 to say it is going to cost us x y and z 62:41 to make this modification which we have 62:44 to modify 62:45 the the budget in in order to do that so 62:48 it has to be a significant amount of 62:50 money 62:53 for us today i guess i'm looking for a 62:56 little bit more specifics who makes that 62:58 decision 62:59 and what's the criteria when you say 63:02 significant 63:03 sydney significant to one person is 63:05 insignificant to another person 63:08 well if you have to do a budget 63:10 modification and we can't 63:11 we have to do a budget modification 63:13 that's that's a reason to go back to the 63:16 council 63:17 if we have the money within the budget 63:19 um just like we've done 63:20 other things and we can say something is 63:22 going to cost us 10 15 63:24 000 we have it we can move it from one 63:27 line item 63:28 to another to make sure we comply that 63:30 is what we we will do 63:32 it's a it was going to be you're 63:34 absolutely right what's 63:35 uh significant to one person is may not 63:38 be significant to another but it's the 63:40 budget that will dictate to us 63:42 what is considered significant and then 63:45 the decision has to be made by the 63:47 council because 63:48 we have to let the council know that we 63:50 either are moving 63:51 money or we need additional money to 63:54 comply 63:56 so or the council can decide that they 63:59 it's an undue burden correct 64:02 that would be the council's decision 64:05 yeah but i don't think they're going to 64:06 say it's an 64:06 undue burden nobody ever thinks that 64:10 well i've gone to i've gone through a 64:12 lot of councils not this one is 64:14 different but i have gone through a lot 64:15 of councils 64:16 okay mr lester can i say something 64:20 of course um if you remember some of the 64:24 uh 64:25 budget items some are in the capital 64:28 program 64:29 and some are not so i believe the level 64:32 of whatever the expenditure is 64:35 whether it's an ada compliant bathroom 64:38 or 64:38 so some items could be small and if some 64:42 items 64:43 could be extremely large it depends on 64:46 where 64:47 the funds could be coming from 64:50 whether it's capital whether it's 64:52 general fund or whether it's 64:54 currently in the budget currently but 64:58 i think to answer your question directly 65:00 tonight 65:01 uh we would have to know a more of a 65:03 specific 65:05 uh question at least i would 65:09 well the specific question mike is who 65:12 decides 65:13 and i guess donna said the council 65:15 decides and 65:16 what's an undue financial burden i guess 65:19 that the council would decide that 65:23 it's decided based yes they would decide 65:25 it but it's also based on the dollar 65:27 amount 65:28 oh that's that's what undo financial 65:31 burden means 65:32 yes all right yeah thank you 65:39 okay thanks roy anyone else uh dave 65:42 uh nope that's all we have right now 65:44 okay 65:46 on to the next one item six is a 65:48 resolution adopting a grant and 65:49 financial award policy for the city of 65:51 long beach 65:54 all right welcome back james all right 65:56 thank you 65:57 so late expenditure policy the um 66:00 the grant policy is generally considered 66:02 to also be a best practice so 66:04 the city receives numerous grants from 66:07 you know local sources from the state 66:09 from the federal government 66:10 uh so this policy intends to promote you 66:12 know long-term and strategic thinking 66:14 with respect to those grants 66:16 grant procedures are outlined uh 66:19 departmental responsibilities are 66:20 outlined 66:21 and that's to ensure proper oversight to 66:23 foster transparency 66:25 and accountability during that grant 66:27 process 66:28 uh and also to minimize the risk of 66:30 non-compliance 66:31 with you know certain grant you know 66:34 grant procedures 66:36 there are roles and responsibilities 66:37 that are discussed 66:39 for a variety of city officials some of 66:40 these include the city manager 66:42 city comptroller corporation council 66:45 various city employees 66:47 and a grant coordinator which would be 66:49 defined by the city manager 66:51 there's also some language which 66:53 discusses the optional establishment of 66:55 a grant committee 66:56 which would assist the city to analyze 66:58 grants before they're accepted 66:59 prior to them being renewed or continued 67:02 and that committee would provide 67:03 guidance and recommendations policy 67:06 further discusses and defines procedures 67:08 surrounding the life cycle of a grant 67:11 which is generally considered to be 67:13 broken into four categories 67:15 those are the pre-award phase the award 67:17 phase 67:18 the administration slash implementation 67:21 the grant 67:23 and the post award phase finally the 67:25 policy 67:26 references other applicable policies or 67:29 laws which city officials participating 67:32 in the grant 67:32 process should be familiar with 67:38 okay any questions from any of the 67:42 council members 67:44 um i just have one question john 67:48 um james there are different grants 67:52 um at different levels and different 67:55 dollar amounts 67:56 and also there's a a share 68:00 of a contribution that sometimes it's 68:03 maybe a hundred percent federal or state 68:06 or 90 68:07 75 50 50. there are 68:11 there are grants well 68:15 just so i understand it sometimes a 68:18 grant is there for let's say 200 000 68:20 but it would require a 50 match 68:24 so the review of this particular grant 68:29 would be a committee to decide whether 68:32 to move forward with that 68:36 i can answer that no no um no it 68:39 one of the the grant um policy says we 68:42 can have a committee 68:44 um if we need a committee really we have 68:47 our 68:47 own internal committee so if a grant 68:51 came up and it was for 200 000 and it 68:54 said it was a 50 68:56 match we would go to ena 68:59 and it would come to myself and we would 69:02 say where 69:02 are you getting the extra hundred 69:04 thousand dollars 69:06 to apply for this grant um 69:10 if it's that it's not in the budget then 69:12 we can't apply for it if we don't see 69:14 where the 69:15 hundred thousand dollars is going to 69:16 come from unless the hundred 000 69:19 is coming from another grant that we are 69:22 applying for 69:23 that we can offset the match thank you 69:26 donna 69:27 you're welcome all right any other 69:30 questions from the council members 69:34 all right should we just bring roy back 69:36 yes we actually have two questions and 69:38 uh roy is first hold on 69:40 okay right ahead okay 69:43 um the one thing that i couldn't find in 69:45 this 69:46 uh is what happens when the grant is 69:49 is over with on a 69:53 a situation where we have become used to 69:55 it and i'll give you an example 69:57 which happened to a lot of schools is 69:59 they got grants for pre-k 70:02 and people got used to it and for years 70:05 they got the money and then all of a 70:06 sudden the money was withdrawn 70:08 and they had to find the money now to 70:10 continue the pre-k 70:11 i think we also have grants that train 70:13 police officers and stuff like that and 70:16 you know long beach has gotten used to 70:18 grants and gotten used to public money 70:20 and then when it's withdrawn when we 70:22 suddenly don't have it 70:23 why wouldn't that be part of this study 70:26 of the future costs 70:27 of continuing the grant after the grants 70:30 withdrawn 70:32 um the the continuation of future costs 70:35 is called the budget 70:36 and so we don't do budgets on uh 70:40 what we think might come and if it is 70:44 something if we're doing a project based 70:47 on the grant 70:48 um and we don't get it the project 70:50 doesn't happen 70:52 and that's what a lot of people make 70:54 mistakes in when they're doing budget 70:56 they assume 70:57 that because they've gotten into the 70:59 past or they've gotten a certain amount 71:01 in the past 71:01 they will continue um ena can tell you 71:04 that is not how the budgets are done 71:07 we assume we won't assume that we are 71:09 actually getting that grant 71:11 until we know for sure so if it is a 71:14 project like i said before 71:16 if it's a project that the grant would 71:18 pay for 71:19 we don't get the grant the project does 71:21 not happen 71:23 so we don't we don't budget for that for 71:26 the continuation of whatever it is 71:28 let's say it's training of police 71:29 officers so we stop the training we 71:32 don't budget for it 71:33 the following year no if we budget for 71:36 it 71:37 if we budget it's an enhancement on 71:39 training police officers 71:41 we can't depend on that grant to fulfill 71:44 our training requirements 71:46 you can't we don't depend on grants as 71:49 revenue 71:50 if we don't understand that we don't 71:52 know for sure 71:53 we're getting that grant then how you 71:56 budget is that you budget to what you 71:58 know you can 71:59 pay for so at that point 72:03 you don't budget for it that's what i'm 72:05 not clear on when you 72:12 so roy hi good evening how are you hi hi 72:16 um i think that there is a little bit of 72:19 a disconnect 72:20 here because what we're trying to do 72:22 we're here 72:23 discussing the grants policy and 72:27 all this like cases that you were 72:31 talking about there outside of the scope 72:33 of this policy right there 72:35 when the grant is over what if so what 72:38 if the grant is over 72:40 then the city management has to decide 72:44 how to continue its operations 72:46 some of the grants that discontinue 72:50 the operations will not be continued 72:52 into the future 72:54 but some will so i think that 72:57 it's really on a one per one 73:01 like you you cannot put it into the 73:04 policy 73:05 um it's really you have to um assess it 73:09 individually based on first 73:12 the need right for the um 73:15 services or the goods that this grand 73:18 particular grant that 73:19 andeth was covering and 73:22 to compare it to the financial situation 73:26 of the city at that point because what 73:29 might sound like a good idea when you're 73:31 flash 73:32 with cash might not be such a good idea 73:35 when you're not 73:36 all you know all i'm saying is why not 73:39 have 73:40 a study part of this a study what it 73:43 would cost 73:43 the city to continue this particular 73:47 thing 73:47 as part of the post award phase 73:49 procedures 73:51 oh okay you mean okay 73:55 you know it just seems like it would be 73:57 planning for the future 73:58 parts all possibilities of the future 74:00 okay thank you 74:01 roy a good example of what you're 74:03 talking about if you remember 74:04 uh the safer grant the city had gotten i 74:07 don't know 74:08 eight maybe eight years ago and they 74:10 hired a couple of firefighters with the 74:12 safer grant 74:13 and then when the grant ran out the city 74:16 at the time made the decision they 74:18 didn't have the cash to keep those 74:20 firefighters on 74:22 and um i believe those firefighters 74:25 wound up getting laid off 74:26 so it's it's a decision that gets made 74:31 when the grants running out and this 74:32 city has to make a decision if it wants 74:34 to continue that and that's the donna's 74:36 point it would become a budget item then 74:38 no john i understand i'm just saying 74:40 that it's good it's good procedure to 74:43 look into the future 74:44 what happened what happens when the 74:46 money runs out 74:48 as part of this policy but listen i 74:51 whatever okay thank you thanks 74:57 all right who else dave we have judy 75:00 vining 75:01 okay hi judy 75:06 gotta unmute judy 75:12 okay yep there you go there you go okay 75:16 um you know for us we've been 75:20 we've had the city as a sub as a 75:22 contractor 75:23 under our grants for a long time 75:26 and the intent in terms of going forward 75:30 has always been 75:31 to establish 75:35 whether it's a program or whatever 75:39 that suddenly not suddenly but over time 75:42 is a value 75:44 to both the city as well as the 75:48 maybe the police department because we 75:50 paid police department overtime 75:52 and the federal thinking is that 75:55 over time given the money 75:59 funded through federal grants as 76:02 subcontractors 76:05 it then gets taken over or in the sense 76:08 of or adopted by 76:09 or enacted through the city 76:12 is that anywhere in this policy 76:20 i'm going to let you feel that donna i'm 76:23 sorry i don't quite 76:24 understand the question i think it was 76:26 similar to roy specifically 76:28 okay yeah give me a yeah okay over the 76:30 past 76:31 20 years one two three four 76:35 federal grants part of those grants 76:38 were um to pay for police overtime 76:43 where we had an mou with the city so 76:46 that they can increase 76:48 the number of 76:51 initiatives activities whatever it is 76:53 that was prescribed in the grant 76:56 um to better um 76:59 [Music] 77:00 address let's say under a drinking for 77:03 one of them 77:04 okay the idea or the 77:07 feeling or the the um 77:10 whatever behind the drug-free 77:13 communities grant was that 77:16 it becomes a process in the beginning 77:18 there is a match 77:21 between what the federal government 77:22 gives us and then what we have to match 77:25 and the match is usually it's not always 77:27 money it's in kind as well 77:31 so at the end of that process the hope 77:34 on the part of the federal government 77:36 who's funded us to do 77:38 this and police department activities 77:40 are part of it 77:41 um is that it becomes an ingrained 77:47 program within the police department 77:52 that is of value to the community and 77:54 then when there's no more federal 77:56 funding 77:57 they adopt it is that addressed or that 78:00 type of procedure addressed 78:02 in this policy you mean if if the money 78:06 is not given to your organization 78:09 because we're sub-recipient correct 78:10 right 78:12 so if and as a sub-recipient if we don't 78:15 receive the money anymore how do we 78:17 address it 78:18 right and the idea is it's over a 78:20 10-year period so 78:22 the money gradually diminishes right 78:25 that's a budget 78:26 that we have to budget for that mm-hmm 78:29 yeah this isn't for grants that we would 78:31 receive 78:32 i understand yeah so there are other 78:34 grants in fact that operate like ours 78:36 too 78:36 yeah if the city is a sub-recipient and 78:39 so 78:40 what we would do is that if for reason 78:42 say just like you just 78:44 the money starts to diminish every year 78:46 but it's going to cost 78:48 it's going to halt in february okay so 78:51 that's the next 78:52 there goes to a budget issue because if 78:55 the city the police department wants to 78:58 continue 78:59 doing the same thing that your grant 79:02 provided to the city then we have to 79:05 budget for it 79:06 okay yeah that becomes a budget issue 79:08 that's not a grant issue 79:10 okay but it also becomes a philosophical 79:13 issue 79:14 in terms of um 79:17 you know i get a question from my 79:19 accountant like 79:20 we're paying the police department to do 79:22 what they're supposed to do anyway that 79:23 doesn't make any sense 79:24 well it does because that's what the 79:26 grant you know dictates 79:29 but it's it's supposed to be a gradual 79:31 procedure 79:32 so that the value plus 79:35 what's been established i'm sure you 79:37 have that with other organizations as 79:39 well 79:40 and i just wondered where in this policy 79:43 this fits 79:44 if we again if it's something to do that 79:47 we had a grant 79:48 and the grant was we were no longer 79:51 going to receive the monies 79:53 and the project would still want to 79:55 continue 79:56 to be budgeted for that which is over 79:59 from a 80:00 grant policy to a budget policy no i get 80:03 that what i 80:04 i guess what i'm saying or or trying to 80:06 explain 80:07 is that for the federal government 80:10 with say the drug free communities grant 80:13 it's a gradual process so it doesn't 80:15 become an abrupt 80:17 okay february money's gone 80:20 and we didn't plan for it right 80:23 i understand what you're saying but as 80:25 the money goes 80:27 say for example we get a grand four 80:29 thousand dollars a year 80:31 year two we still want to do the program 80:33 it's going to cost exactly 80:35 but only you're going to get 750 80:39 so 250 has to go into the budget 80:42 no i hear what you're saying and i 80:44 assume no that would not be 80:45 that would not be in the policy but i am 80:47 saying within the policy 80:51 there should be some acknowledgement 80:53 that 80:56 some grants are structured so that it's 80:58 a gradual process 81:01 of diminishing funds while the program 81:04 continues 81:05 so if it's valuable or of value to the 81:08 community 81:10 so it becomes something that eventually 81:13 gets taken over by the community 81:15 and judy that's regarded by the federal 81:17 government taking over 81:19 okay 81:22 all right thanks judy 81:27 all right dave do we have anyone else uh 81:29 no that's that's all we have right 81:31 for this item okay so let's move on to 81:33 item 81:34 seven item seven is a resolution 81:36 authorizing the city manager to enter 81:38 into a license and 81:39 operating agreement for the management 81:41 of a day care center with the sole 81:43 responsible proposer 81:46 that is mr joseph lupo 81:54 okay 81:56 all right hi joe 82:01 joe you're on muted go ahead 82:08 you guys hear him nope maybe 82:12 maybe he's watching the steelers game no 82:14 no i'm here 82:15 oh there he is i'm not even a steelers 82:19 fan 82:19 sorry well somebody has to be yeah yeah 82:22 let's john do it yeah right so 82:24 hello everyone how are you um as you're 82:27 all aware 82:28 the magnolia center has been vacant uh 82:30 for some time now 82:32 as you may recall back in july the city 82:34 released an rfp for the operation and 82:37 management of a daycare facility to be 82:39 conducted 82:39 at the magnolia center now the sole uh 82:43 proposer of that uh 82:46 in response to the rfp excuse me was the 82:49 baryon florence friedberg 82:50 jewish community center inc or jcc for 82:54 short 82:55 the jcc is headquartered in oceanside 82:58 and it has been providing daycare 82:59 services 83:01 to the long island south shore 83:02 communities for nearly i'm sorry for 83:04 over 50 years 83:06 with respect to the rfp and the proposal 83:09 in response 83:10 our office was tasked with assisting in 83:13 the contract negotiations 83:15 and the preparation assisting in the 83:16 preparation of the contract related to 83:18 that rfp 83:21 now the licensing fee schedule is set on 83:24 an 83:24 escalating scale for an initial term of 83:26 five years 83:28 and there is also an option for an 83:30 additional two year renewal 83:32 but that extension period is at the sole 83:34 discretion of the city 83:36 um with respect to any terms of the 83:39 contract or any questions 83:40 that anyone may have i'm more than happy 83:42 to uh 83:43 to address any questions 83:48 all right any questions from the council 83:49 members 83:52 all right what i what i one of the 83:54 things i think it's important 83:56 to point out to people what what this is 83:58 doing is the 83:59 the city was effectively in the daycare 84:02 business and was losing their shirt on 84:05 it 84:05 we were spending a huge amount of money 84:09 and collecting in fees for the daycare a 84:12 small fraction of what it cost the city 84:14 to run this program 84:18 it also created huge liability issues 84:21 for the city as well should something 84:23 happen 84:24 and then all the criteria that and the 84:27 licenses that have to be maintained to 84:28 run a daycare so what we're doing here 84:30 is 84:31 we're still having a daycare but now the 84:33 city's getting out of the daycare 84:35 business and we're actually going to 84:36 collect 84:37 rent on the facility so going from 84:40 operating 84:41 massively in the red on this thing we're 84:44 still going to have day care and the 84:45 city is actually going to come out in 84:47 the black 84:47 on this deal financially so um 84:51 it's kind of important to note this is 84:53 this is real good for the taxpayers it's 84:55 still 84:56 we still have daycare and but now 84:59 it's not being subsidized by the 85:01 taxpayers anymore 85:07 and uh so now that i said that like i 85:09 said any 85:10 before we go to the public so anything 85:12 from the other council members 85:15 or anyone else okay 85:18 dave let's hear from roy 85:22 roy you're on muted dad okay um 85:26 john i i hear what you're saying and 85:28 it's a wonderful thing 85:30 to not lose money but i'm looking at the 85:33 budget 85:35 and we budgeted for expenditures 85:38 uh magnolia community death center 85:41 daycare 85:41 182 9116 85:45 for last year for the last fiscal year 85:48 the 85:49 income on that the revenue hold on a 85:52 second 85:53 was uh hold on a second 85:56 about uh 400 86:00 uh one second 425 86:04 000 that's a line 86:07 uh a zero zero twelve 86:10 uh forty two one three so that seems to 86:14 me 86:15 according to just these numbers that we 86:17 made 242 86:19 000 on that and i'm gonna let 86:22 that's a nina question that's an ina 86:24 question guys 86:26 hi roy hi again um so 86:29 um what um the operations 86:33 of magnolia center what you see 86:36 in a budget uh for the department number 86:40 7330 yes 86:43 right so um that that 86:46 just uh salaries of some of the staff 86:51 um in order to evaluate operations 86:54 of the center you have to combine it 86:57 with 86:58 some of the line items actually in 87:01 a department 7310 uh 87:05 which is the youth and family services 87:09 right so i'm sure that you 87:12 like we had four 87:15 um i think they're called program 87:18 specialists 87:19 uh that are involved in a program and 87:22 then there was 87:22 about um a director clerical staff 87:27 so really it was more than 135 thousand 87:30 dollars um 87:32 so uh but when i look at it um i think 87:36 that um you really need to combine it 87:40 uh with the like i said with the youth 87:43 and family 87:43 services and um 87:46 [Music] 87:48 and uh was to um incorporate 87:52 uh the fringe benefits so when we 87:55 evaluated uh this operation 87:58 it was depending on the year but from 88:02 year to year 88:03 um the program was losing about 88:06 from 200 to 300 000 um 88:10 and you would ask me probably your next 88:13 question would be then 88:14 why are these people accounted in a 88:17 different department 88:18 because a lot of the programs that are 88:20 run in the youth and family center 88:23 uh they are very similar to what's done 88:27 in magnolia in terms of dealing with the 88:30 children and the same staff 88:33 could be involved in one program in the 88:36 morning 88:37 and another program um in afternoon 88:41 so i guess here you would just have to 88:44 trust 88:45 us on that and uh um 88:49 that's the worst thing to say uh believe 88:52 me 88:54 that's the worst thing but you know what 88:56 you can do a very quick reasonable step 88:59 reasonableness testing like i said 89:02 and um given the fact that we have 89:06 four full-time programs specialists are 89:08 teachers um 89:10 i'm i'm sure that it's pretty quickly 89:13 adapted to more than one authority 89:16 and that you don't need to trust me on 89:19 yeah i look 89:20 i'm just looking at the budget the 89:21 revenue in the budget 89:23 you know you have fifty five thousand a 89:25 hundred fifty thousand hundred eighty 89:26 five thousand two hundred thousand 89:28 seventy five thousand and four hundred 89:30 twenty five thousand 89:31 on these on these on the budget twenty 89:34 twenty bucks 89:37 we budgeted a million dollars but in 89:39 actual 89:40 revenues came at 652 000 89:44 roy also in 2019 actual revenues for the 89:48 whole for 89:49 all the youth and family services 89:51 including magnolia 89:52 early child care came at 870 to about 89:58 873 89:59 000 while the total expenses for 90:02 operating those programs including 90:05 fringes 90:06 were 1.6 million okay i just wish i 90:10 could see that in the budget 90:12 that's all i mean it's not in a budget 90:13 it's in a financial statement i mean 90:16 we're talking about the budget could be 90:18 we 90:20 i guess um it's now a common knowledge 90:24 that 90:25 budgets before this fiscal year 2021 90:28 budget 90:29 um were not 100 realistic right 90:32 revenues were um overestimated 90:36 so when we're looking at this um 90:39 budget for 2020 at over a million 90:41 dollars 90:43 um the actual um 90:47 um revenue collected was less than 700 90:50 000. okay then let me just ask you this 90:53 question 90:54 in the revenue of this year's budget 90:56 this year's budget 90:58 you have in the expenditures you have 91:00 youth and family services at 140 91:03 and magnolia community center daycare at 91:06 182. 91:09 where do you get 1.6 million 91:14 are you talking about fiscal 21 budget 91:17 or fiscal 2020 91:19 the last budget 2021. 91:22 we don't have the 2122 budget yet 91:25 no the last budget you put out 91:28 the adopted 2020 budget 91:32 2021 okay the adopted 91:35 2021 budget you have to look at the 91:39 total 91:40 between the total magnolia community 91:43 center that daycare 91:45 you're talking about revenues are 91:46 expensive expenses 91:49 expenses so you have a hundred and 91:51 eighty thousand dollars in expenses 91:56 magnolia community center day care 180 91:59 and about 140 in 92:02 youth and family services okay 92:05 so it for the total of um 92:11 um 322. 92:14 yeah so um 92:18 what is so so what what's the question 92:22 you said that the total expenditures 92:24 were point six million 92:27 i think t roy i think we're talking 92:29 about the year we're talking about right 92:30 now 92:31 1.6 million dollars is fiscal 2020 92:36 is the last fiscal year 92:40 the year that ended june 30th 2012 92:44 right 20 20 20. okay 92:47 this fiscal year we budgeted in revenues 92:50 about 516 000 92:54 both revenues and expenses for this 92:57 programs were budgeted at about half a 92:59 million dollars 93:01 we are on very well and trying to reach 93:04 half a million dollars 93:06 in terms of the expenses however we are 93:09 not 93:09 on trying to reach half a million 93:11 dollars in revenues 93:13 um i'm sure if you have the budget open 93:16 in front of you 93:17 you can look at the um 93:22 you can look at the revenue for the 93:24 camps right and i 93:26 think i'm talking for my memory but i 93:28 think we had about 175 93:31 000 budgeted there for the mini cam 93:35 for lido that didn't happen at all 93:40 oh we knew that that's why we borrowed 93:42 the 4.2 million dollars we knew covid 93:44 was going to affect all those things 93:48 um 93:59 to finish fiscal 2020. because of all 94:02 these problems 94:04 no all right well she's talking about 94:06 the the 4.2 million dollars was borrowed 94:09 for fiscal year ending june 30th 2020. 94:13 the budget she's talking about is for 94:15 the fiscal year ending june 30th 2021 94:22 how could we have been short that much 94:25 when covert hadn't really hit us until 94:30 march 94:32 well i you know roy i i i i think that 94:35 what we need to do 94:36 is we need to set up a zoom call so we 94:39 can go over the budget with you 94:41 uh so you could better understand the 94:43 budget and you can better understand 94:45 youth and family services 94:47 and how the expenses are really uh 94:50 gathered 94:51 uh yeah i would like that because i look 94:53 at i'm just looking at the budget 94:55 that's the only thing that we people 94:56 have i i 94:58 know the public all only has this budget 95:00 to go on 95:01 and it doesn't make sense what you're 95:03 talking about and well not you 95:04 you know that we're spending 1.6 million 95:07 here but all right he was talking about 95:09 the previous year 95:10 the 1.6 million was the previous year 95:12 roy so we 95:14 will do is you know i'll call you and 95:16 we'll set up the zoom calls to go over 95:18 the budget with you 95:19 so that we can answer any questions that 95:21 you may have 95:22 okay thank you thanks all right 95:26 anyone else dave um can i just add one 95:29 more thing please 95:30 sure good um you know mr lester another 95:33 thing that uh 95:34 you know to take into consideration sir 95:36 um as you said we are in a post-covered 95:39 world now so we're in a world where 95:40 enrollments in schools are down 95:42 drastically 95:44 most many students are learning 95:46 virtually 95:47 so under that model in this new world 95:49 that we're living in 95:50 it you know it only goes to to reason 95:53 that 95:54 enrollments and day daycare facilities 95:55 are also gonna you know kind of suffer 95:58 uh the same thing that school 95:59 enrollments are and they're gonna be 96:00 down 96:01 so at this point now i mean you know as 96:03 mr bendo said earlier even 96:05 just with respect to limiting the city's 96:07 liability limiting the city's liability 96:09 on what appears to be 96:11 is going to be you know a uh a decreased 96:14 enrollment of 96:15 uh of these services it really does uh 96:18 make sense and serve the city's purpose 96:20 sir 96:23 and we're still provided the service is 96:25 still being provided but the city's not 96:27 taking a financial bath on it 96:30 absolutely and that's good for the 96:31 taxpayers 96:33 so uh dave did we have anyone else 96:37 was it that was it that was it 96:41 okay he's gonna keep you on your toes 96:43 xena 96:44 so um 96:47 okay i know that 96:52 all right let's move on to item eight 96:54 item eight is a resolution authorizing 96:56 the city manager to negotiate agreements 96:58 with student swim incorporated long 97:00 island swimming limited 97:01 aka long island aquatic club for swim 97:03 programs 97:04 at the city's aquatic center 97:08 okay i think we need to make an 97:09 amendment to this 97:11 um should we get that out of the way and 97:13 then we'll do 97:14 the discussion it was for both this item 97:17 and item nine 97:18 right i believe uh rich 97:21 um i'm sorry 97:25 do you want to explain it or you just 97:26 want us to do it 97:28 i can explain um well these uh both 97:31 items eight and nine i'll probably 97:32 repeat myself when we call item 9. 97:34 um the recommended modification or 97:37 amendment 97:38 is in the resolved portion rich yes this 97:41 is less can you just 97:42 move a little forward so we can hear you 97:44 better better 97:45 thank you okay uh for item number eight 97:49 uh in the resolve portion uh the 97:52 recommended amendment or modification 97:54 would be 97:55 where it says uh the city manager b and 97:58 she is hereby 98:00 is authorized to negotiate agreements 98:01 just add um negotiate 98:03 and enter into agreements 98:08 and rich we want to do this for both 98:09 items correct uh that would be my 98:11 recommendation 98:14 uh can we amend both in one 98:17 voter we have to do it for each one 98:20 individually 98:22 it's the same language going into the 98:24 same location in 98:26 both items if you want to do it 98:27 separately we can do it separately uh 98:29 yeah why don't we do it separately just 98:31 to 98:32 make sure since it's uh uh 98:36 kind of resolutions all right 98:40 does everybody want to make the motion 98:41 to add add this language into the 98:43 resolve clause 98:44 yeah i'll make the motion go ahead scott 98:46 i'll second it 98:49 voting councilmember de laurie yes 98:51 councilmember mandel 98:53 yes councilmember charleston yes uh 98:55 president bendo 98:56 yes okay 99:00 okay uh so 99:02 [Music] 99:05 who do we have uh 99:08 rich are you talking on this one yeah i 99:09 can speak on this one sure okay am i 99:12 coming in okay 99:14 gotta ask liz better 99:17 thank you sir no problem um sorry about 99:19 that so 99:20 i won't belabor i mean this is all in 99:22 the resolution itself but as everyone 99:24 knows and as 99:25 john mcnally's already stated uh earlier 99:27 on in the city manager's update 99:29 uh we went out to to rfp 99:32 for swim programs at uh at the wreck 99:36 and scoot and swim and liak came in 99:40 in terms of responses again this 99:43 resolution is for the purpose of 99:45 uh negotiating and entering into 99:46 agreements with uh with both lyac 99:48 and the student swim team essentially 99:52 uh steps after this resolution is that 99:54 myself 99:55 the city manager and the wreck will be 99:58 going to the table with uh 99:59 scootin and liak hammering out uh 100:01 agreements uh 100:02 as quickly and as uh thoroughly as 100:05 possible 100:06 to get everyone back in the pool um kobe 100:08 willing you know 100:12 yeah so it's important to note and uh 100:14 john mcnally talked this 100:15 about this earlier what we're doing here 100:16 is we're getting away from 100:19 the old practice of verbal and handshake 100:22 agreements that then create 100:24 big liability issues for the city 100:26 because nothing 100:27 is defined in writing 100:31 and everything's in a gray area so now 100:35 everything's going to be done properly 100:37 everybody's going to have contracts 100:39 um you know proper 100:43 rfps and things like that and so that's 100:45 what this is doing 100:46 for the all these programs at the 100:48 recreation center 100:50 right the goal here is to get you know 100:52 uh move forward with solid agreements 100:54 with our you know 100:55 third-party vendors uh obviously be in 100:58 accordance with procurement law and uh 101:00 give the city and its constituency the 101:02 recreation it wants and deserves 101:06 adding accountability to the process 101:09 and transparency so uh okay 101:12 any questions from the council members 101:15 um i just have a comment uh john okay 101:19 um if there are multiple people that are 101:21 looking to ask questions 101:23 um i would just ask for anybody who 101:26 hasn't 101:27 spoken yet to go first 101:33 are you asking roy to wait 101:34 [Music] 101:37 all right it's up today anyone else from 101:39 the council 101:41 all right dave who we got nobody nobody 101:45 wow no hands raised okay 101:49 you got off rich he was 101:52 all right uh let's move on to item nine 101:55 item nine is a resolution authorizing 101:56 the city manager to negotiate agreements 101:58 for various recreation programs 102:00 and um i guess we'll call for the same 102:02 amendment to add 102:04 the uh and enter into it to the resolve 102:07 clause who will make that motion 102:11 i will thank you second 102:14 i will voting councilmember delorey 102:17 yes councilmember mandel yes 102:20 councilmember tristan 102:21 yes president bendo yes okay 102:25 continue all right you gonna do this one 102:27 too rich 102:28 sure um kind of repeating myself but 102:30 again we went out to rfp 102:32 uh on the various recreation programs 102:34 that can be held at the wreck 102:36 um did it in a very timely manner 102:40 uh pretty quick to my uh to my opinion 102:42 we had five vendors submit proposals uh 102:45 meeting the uh i guess the outlines of 102:46 that rfp um 102:48 some of the most of them were uh 102:50 individuals that were third-party 102:52 vendors with us 102:53 we did have one responsive 102:57 proposal that is unique and interesting 102:59 called cook grow and learn 103:01 curious to see how that develops but 103:03 essentially the same exact 103:05 steps are going to apply here as it did 103:06 with the with item number eight 103:08 we're going to sit at the table with uh 103:10 with all of these uh 103:11 vendors hamlet agreements and get them 103:14 back to uh 103:15 recreating as it were 103:19 okay um one of the 103:23 uh well let's see one of the vendors 103:26 uh i believe we we still hadn't named 103:28 the city 103:29 as a uh additional insured right 103:33 friends of long beach hockey so will 103:35 that be taken care of during the 103:38 during the uh the talks yes so 103:41 essentially all of these all these 103:43 agreements are contingent upon the 103:44 proper insurance the proper defense and 103:46 identification 103:47 um we just want to ensure that the city 103:49 is protected its residents are protected 103:51 and um right because we didn't see any 103:53 paperwork uh insurance paperwork from 103:55 cook grow learn either 103:57 right but those will be part of the uh 104:00 the process 104:00 yeah okay i could definitely update the 104:02 city council as uh you know as i receive 104:04 those documents 104:05 sure all right any questions from the 104:08 council members 104:13 okay let's see if roy is going to get 104:15 rich on this one 104:17 okay i have tw i have two um two folks 104:19 with their hands raised we'll start with 104:21 peter roberts 104:23 okay hi peter hi how are you tonight 104:27 got a question so this is a 104:29 [Music] 104:31 authorization to enter into a contract 104:33 are the final contracts going to be 104:34 brought up before a council meeting to 104:36 be approved or 104:38 is this just going to be done and 104:39 nobody's going to know what the details 104:41 of the contracts are 104:43 second of all how does the contracts 104:46 for the people in the skating rink have 104:49 to do with the proposed rfp that 104:51 supposedly is coming out 104:53 for the concession yet to take over the 104:56 rink 104:59 okay um good evening mr roberts so to 105:02 your first question 105:04 um the way this resolution works is is 105:07 that the council would be authorizing 105:09 the city manager and obviously her team 105:11 to negotiate agreements and enter into 105:14 them with these third-party vendors 105:16 um there'd be no there would be no 105:17 subsequent step uh 105:19 involving the council in the second 105:20 meeting for this particular resolution 105:23 so your second question regarding the 105:26 i believe the ice arena rfp i guess 105:28 that's what you're referring to is that 105:29 right 105:30 correct okay so with that one 105:32 essentially 105:33 the contemplation here is that these 105:37 particular 105:38 these particular third-party vendors 105:39 would be notified that 105:41 uh that rfp is forthcoming i think 105:43 they're all aware of it at this point i 105:44 think we maybe have to notify one of the 105:46 awardees 105:47 so essentially once this uh once these 105:50 agreements are hashed out those 105:51 agreements will include that caveat that 105:54 if and when an rfp results in an award 105:56 to someone to operate the ice arena 105:59 they will have to enter into third party 106:01 contracts with that uh 106:02 with that operator in order to continue 106:04 to move forward 106:07 so it's not like we're hiding the ball 106:08 on this we're actually trying to be as 106:09 forthcoming as possible 106:10 well the rfp says that it's for a term 106:13 of one year with the city for too often 106:14 so 106:15 hypothetically speaking if you put it 106:16 out to bid next week 106:18 and somebody took over in just 106:20 arbitrarily say april 106:22 where does that leave those people those 106:25 concession years that 106:27 bid i mean essentially it would be the 106:30 same concept right so the idea is is 106:32 you're being awarded this rfp to you 106:35 know operate out of the ice arena 106:37 with the knowledge that there may be 106:39 someone subsequently who's going to end 106:40 up operating this and controlling it 106:43 um so there's going to be some 106:44 discussion to be had with all of these 106:45 vendors 106:46 and we're going to get together with 106:47 them and at least you know hatch those 106:49 things out 106:51 okay because like i said before the rfp 106:53 says that 106:54 it's for a term of a one-year contract 106:56 with the city's option for two 106:58 additional one years 107:01 right what's the maximum term of one 107:02 year well 107:04 that's not it one year could be one year 107:05 could be month to month one year it 107:07 could be six months it could be three 107:08 months 107:10 so it's not a contract it's not a 107:12 calendar year then 107:13 we we don't have a contract yet is what 107:14 i'm saying so no it's not a calendar 107:16 year 107:18 you know from the start there a 107:19 definitive start date and definitive end 107:21 date 107:22 as a year that's something that we have 107:25 to negotiate 107:26 and discuss okay thank you 107:30 no problem okay 107:33 and who's next dave rory lester 107:36 okay right you're on muted go ahead okay 107:40 um i guess when you guys first took over 107:43 or when you were running you were 107:45 talking about 107:46 putting the decisions back in the hands 107:48 of the city council 107:51 i'm not that i don't have faith in donna 107:53 i have a ton of faith in donna 107:54 but i don't understand now why you would 107:57 allow something like this where we're 107:59 talking about five 108:00 different contracts all to be negotiated 108:03 and entered into i can understand the 108:06 negotiations 108:07 but you guys have no say in this and 108:09 that's basically why you were elected 108:12 not to pass the decisions on to somebody 108:14 else to make these decisions 108:17 and nobody's going to know anything 108:19 about these contracts 108:21 nobody's going to see them beforehand 108:23 they're just going to be 108:24 the city's going to be bound by them 108:27 with 108:28 absolutely no disclosure 108:31 why well it just doesn't sound like what 108:33 you ran on 108:34 well first nobody the the public doesn't 108:38 see contracts before they're voted on 108:40 that what they 108:41 see is that a contract is being voted on 108:43 that's a 108:45 b as you just heard from rich these are 108:49 sort of akin to month to month because 108:50 there's an rfp 108:52 coming out for 108:55 for somebody to take over operations of 108:57 the ice arena 108:58 so what this is doing is this is 109:00 allowing the city 109:02 to have programming back in the ice 109:05 arena 109:06 uh while the contracts are being 109:08 negotiated because right now it's the 109:09 kids that are paying the price 109:11 for this past practice of these 109:14 handshake agreements and stuff 109:15 so we're trying to make it so the kids 109:17 can get back in the ice 109:19 and back in the pool uh and get their 109:21 programs going again 109:25 and and why can't the city council be 109:28 the ones that decide 109:29 that this is a good deal or not a good 109:31 deal 109:32 i mean yes i can understand you want to 109:36 get the kids back there i don't 109:37 understand why 109:38 cooking lessons have to be in the ice 109:40 arena but regardless 109:42 um i understand what you're saying but 109:45 why would you guys not want to make that 109:47 decision 109:49 why would you not want any say in that 109:51 decision 109:53 we're having a say in a decision with 109:55 this vote 109:58 yeah and the decision is i'm not going 110:00 to 110:01 even look at it i'm going to let 110:03 somebody else make the decision 110:07 if you want to look at it that way 110:08 that's fine we have a professional city 110:10 manager 110:11 that knows what she's doing and isn't 110:14 following 110:14 some of the past practices that gave the 110:17 star away 110:18 i i agree i agree as long as she's there 110:21 i do have faith 110:25 i just wanted to mention the cook and 110:26 learn is online 110:30 so what john just said we needed to get 110:32 this 110:33 done because we're getting the kids in 110:35 the ice arena 110:37 yes yes but the cooking learn just 110:39 happened to be another program that came 110:41 in 110:41 but i just wanted you to know that the 110:43 cooking learn was 110:45 online yes that's what it says yeah 110:48 that's 110:48 what we were trying to do yeah we're 110:50 trying to get um the ice 110:52 arena and get the kids back in and on 110:55 the ice 110:56 um because we had to close down for a 110:58 couple of different reasons 111:00 um it's just not me it's a team which 111:03 includes uh corporation council 111:05 and procurement department and uh 111:09 also ena and i'm sure everybody that's 111:12 been on the call knows that ina also is 111:14 going to make sure that 111:16 we're doing everything in the best 111:17 interests of the city um 111:20 i understand what your question that 111:22 you're asking and i'm i'm happy to say 111:24 that the council has 111:26 faith is that the team that we have in 111:28 place now is going to 111:30 make sure our eyes are dotted and t's 111:32 are crossed 111:33 any any other situation it would be that 111:36 we would not bring this 111:38 until december um for 111:41 everything to be passed and so what 111:43 we're trying to do 111:44 is we're trying to tell the council 111:48 everything that's going on and then 111:50 allow us to finish 111:52 all of the negotiations to make sure 111:54 everything falls into place 111:56 as far as the ice arena um when the 111:59 contracts the 112:00 individuals that were at with the ice 112:02 arena it was month to month 112:04 and it's been known that the city is 112:06 trying to get the rfp together to 112:09 send out to um see 112:12 to have someone come in and take over 112:14 the ice arena 112:15 so that those contracts are really month 112:18 to month and i believe they were ending 112:19 in april as well 112:21 we have been really working hard on 112:23 making sure this new ice arena rfp 112:26 goes out is proper um as well as 112:30 taking into consideration some project 112:32 work 112:33 um that we had already received grant 112:35 money for that we also 112:37 complete that so roy again thank you uh 112:40 for your faith and know that um and i'm 112:43 happy that the council has the faith in 112:45 us 112:46 and that we're not trying to do anything 112:48 uh with contracts that 112:50 would hurt the city at all i know you 112:56 wouldn't 112:59 okay anything else right no no 113:02 okay great uh anyone else dave 113:06 uh colleen ferrick okay hi colleen 113:12 hi how are you good i just had a quick 113:15 question i'm not really um 113:17 too up on all the policies procedures 113:20 whatever 113:21 how long does this usually take though 113:23 to get it in place 113:24 um my son's used to being on the ice 113:27 like seven days a week he's really 113:29 suffering without it 113:31 i know that they just opened up for the 113:33 sticks and pucks and 113:34 different things but i'm just curious 113:37 like 113:38 how long does this usually take 113:41 uh i'm gonna i'm gonna let donald trump 113:43 but i'm guessing once this is passed 113:45 it's 113:45 if this is passed tonight um things will 113:47 go back into place 113:48 starting tomorrow so it depends on how 113:51 long it takes those individual companies 113:53 to get back 113:54 up and running but we can call them 113:56 tomorrow and say it's a goal 113:58 oh great because i know we'll be up and 114:00 running then thank you 114:02 oh you're welcome makes me happy thanks 114:05 okay great bye dundo 114:08 bye all right anyone else dave 114:13 that's all i show right now okay let's 114:16 move on to item 10. ann 119:05 conway hey okay and you're on mute from 119:09 our school board 119:15 hi everybody can you hear me it's annie 119:17 conway hi annie 119:19 yep hi how are you how are you how is 119:21 everybody 119:22 um i just wanted to um 119:25 first of all what a great meeting um 119:28 it was wonderful listening to all of you 119:30 as it usually is 119:32 and i don't want to take up much of your 119:34 time but 119:35 i just wanted to give a big thank you 119:39 to all of you um as some of you may know 119:42 on november 7th over 119:45 over 20 kids from our long beach school 119:48 district 119:49 got together and they celebrated 119:54 dr martin luther king's visits to long 119:56 beach 119:57 by presenting a plaque in his honor 120:00 now this project was presented to the 120:03 city council back in february 120:06 and you know mr bender miss trustin 120:09 you were also very welcoming and pleased 120:12 with the project and you supported us 120:14 throughout the whole thing so i really 120:15 want to thank you very much 120:17 um it the kids worked 120:20 very hard for this project um 120:24 thanks to miss truston and miss monique 120:26 power we were able to use 120:27 the rec center for practices following 120:30 covet of 120:31 following covert practices of course but 120:33 the kids were able to practice with the 120:35 podium 120:36 mr joe brand made sure that we had the 120:39 space available so that we could use 120:40 social distancing 120:42 when needed and then on november 7th 120:46 the plaque was presented on the 120:48 boardwalk 120:49 tommy cantor john mcnally sean o'neill 120:52 and many of the peop members of the csc 120:55 were there 120:56 they helped to set up the podium they 120:57 helped to set up the mic 120:59 they installed the plaque and the 121:02 ceremony itself 121:03 was just such a wonderful sight to see 121:06 you had to see 121:07 our students they so proudly spoke in 121:10 front of a crowd 121:11 of so many and they really showed their 121:14 ideas of 121:15 how wonderful our long beach community 121:18 can be 121:18 and how wonderful our long beach 121:20 community already is 121:22 so i really just wanted to take the time 121:24 to thank 121:25 all of you so much for making this such 121:28 a 121:28 wonderful memory for our students you 121:31 know 121:32 long beach is such a community that 121:36 we're all very diverse and our pride 121:39 is shown not just in our apparel but the 121:42 fact that we all work together 121:44 and this was a project where the long 121:46 beach school district 121:47 worked together with city council beach 121:50 to bay 121:51 the csc the concerned citizens of north 121:55 park 121:55 the martin luther king center and just 121:58 so many other 121:59 the parents so i just really wanted to 122:02 take the time to thank 122:03 everybody so much for all of their hard 122:05 work and dedication to this 122:07 you really gave our kids a wonderful 122:09 memory so thank you 122:12 yeah that's great we could do that i 122:14 mean i'm 122:15 guessing also there's a lot of people 122:17 out there that didn't even know 122:19 that martin luther king jr came here to 122:21 long beach 122:23 and spoke and so now it is something 122:26 that lets people know that 122:28 so uh it's important and not only just 122:30 for the kids that did it but for the 122:31 kids 122:32 going forward so they uh 122:35 have the ability to to know that yes um 122:39 john dr dr martin luther king came to 122:42 our city 122:43 over three times in the 1950s and the 122:45 1960s 122:47 and there were there were newspaper 122:49 articles and thanks to long beach 122:51 historical society we were able to dig 122:52 them up and do the research 122:54 so now when you walk on the boardwalk 122:56 you'll be able to read about how he came 122:58 to our city and he inspired 123:00 so many of us and it'll be there forever 123:04 so our youth be able to go by and see it 123:06 the plaque is 123:08 installed on riverside so as soon as you 123:10 walk up the ramp you can see it 123:12 and again thank you thank you again so 123:15 much for supporting this project 123:17 our pleasure and i if i could just take 123:20 a moment just to 123:22 because we are not in city hall and we 123:26 don't have the opportunity to give out 123:28 proclamations 123:29 i'd just like to mention those students 123:31 that did 123:33 such an incredible job so thank you to 123:37 sean bourne 123:38 tyrese byron tyler caldo michael contras 123:43 maura conway zoe conway oscar 123:46 the udo johnny diamond natalia 123:50 gonzada shirley hernandez 123:54 destiny hurt frankie kelleher ryan 123:57 milland 123:58 wyatt parker kelly ryan 124:02 elijah rodriguez tony 124:05 donia zabo mana 124:09 hayden soulfield and teresa tarantino 124:13 thank you so much thank you anne thank 124:16 you liz 124:17 oh and i would also like to thank denise 124:19 ford for coming by 124:21 and visiting to see the plaque and also 124:23 miss donna gayden thank you so much for 124:25 coming by 124:26 to watch the ceremony i know that due to 124:29 covert restrictions we couldn't have so 124:30 many people so we really appreciate 124:33 the time you came to you took to come 124:35 out and see them 124:38 all right thanks annie 124:41 thank you all right who's next dave 124:47 okay next is roy lester okay 124:51 welcome back thanks annie it's great you 124:54 being here 124:56 thank you um and you're doing a great 124:58 job 124:59 uh listen i listened to robert talk 125:02 about the haberman thing 125:04 and i've been talking to you guys about 125:06 it for three years 125:07 and i i know i sound like an alarmist 125:10 but we've lost just about every appeal 125:15 every case every decision 125:18 in this particular case for robert to 125:20 say well we still we got this to go and 125:22 that to go 125:23 and is you know hoping for the good the 125:26 good luck 125:27 when we've had a a string of losses 125:30 that's unbelievable 125:32 i think is not realistic and i think 125:34 we're going to have to start 125:36 planning what we're going to do if we 125:39 don't 125:41 win this thing and the odds of us 125:43 winning it i don't even see 125:45 and rich maybe you can tell me how are 125:47 we appealing this to the court of 125:49 appeals 125:50 it was a 4-0 decision 125:53 and it was it was a decision a couple 125:56 years ago 125:57 and he says we still can appeal it 126:00 rich is that true well there are some 126:04 theories upon which we can appeal yes 126:06 um basically i mean listen bob bob's you 126:09 know 126:09 you know what bob's role is bob you know 126:11 he's outside counsel he's a litigator 126:13 he's here to represent the city's 126:14 interests i understand 126:16 you said you don't want to be an 126:17 alarmist i get it like this is something 126:19 that's been looming over the city 126:21 we have full faith in bob that he's 126:22 going to you know do 126:24 argue as best he can you know but he 126:27 lost it for us before 126:28 i mean didn't he wasn't he the attorney 126:32 or which i mean wasn't he the attorney 126:35 arguing 126:36 in front of the appellate division 126:39 i believe he came before the uh before 126:41 the city council last time with uh 126:43 with an appeal might have been on the 126:45 ice star matter though i'm not 100 sure 126:46 no no 126:47 um of course it might have the highest 126:49 cross i don't i don't have the entire 126:50 history of the case before anymore but i 126:52 think 126:53 um you know there's 126:57 it's it's a damages inquest and as an 126:58 attorney i think you know 127:00 you live and die day by day in 127:02 litigation so uh 127:04 bob's just trying to do the best he can 127:05 for the city and try to see if we can 127:07 come out of this you know 127:08 in a good way i know what he's trying to 127:10 do rich what i'm asking is is it 127:12 realistic 127:13 do you see i i know litigation can 127:16 always go 127:17 different ways but you know what when 127:19 you've lost four 127:20 five times and you don't even have as 127:23 far as i know we don't have an appeal to 127:26 the uh court of appeals 127:29 we're stuck with the decision and now 127:32 it's just a matter of 127:34 how much correct me if i'm wrong 127:37 please because that's how i read it 127:41 no i mean listen you you're reading it 127:42 right i i can't i can't really comment 127:45 on you know 127:46 the on the gloom you know what i mean 127:50 this is a projection that you're saying 127:52 i get it i'm not i'm not in a position 127:53 to comment on the litigation and 127:55 what our steps are in the appeal because 127:57 i haven't evaluated the appeal to the 127:58 board of cases 127:59 uh so i couldn't tell you at this point 128:02 but um 128:02 what i'm what i'm saying is if we're 128:04 facing this don't you think we should 128:07 start planning something start having 128:10 some sort of contingency plan 128:13 sure yeah well why aren't we we never 128:16 even discuss it 128:17 it's like it doesn't exist for three 128:20 years contingency plans 128:22 so lay it out for me right well i i 128:24 don't know i mean 128:25 you know i know what it would cost if we 128:28 had to let's say we had to bond 128:30 um a hundred million dollars we did that 128:34 in the school board 128:35 it cost everybody some money but we used 128:38 it to build things 128:39 is it possible yeah could the city 128:42 survive it it would be tough 128:44 we also have the option of bankruptcy 128:46 the question is how much do we have in 128:48 assets 128:49 and what could we afford to give up 128:52 they're different things we could do but 128:53 so far 128:54 every time it's been mentioned it's like 128:56 you know oh 128:58 you know i'll covert it's a fake thing 129:00 that's what i'm hearing basically 129:02 and i'm asking you am i missing 129:04 something 129:06 that's why i'm asking you what would you 129:07 do or what your thought process is on 129:09 this because i mean you're asking me if 129:10 it's realistic to think that we can come 129:11 out on top of this 129:13 i'm not i'm not in the courtroom every 129:14 day i can't uh even if not 129:18 pending litigation you get what i'm 129:19 saying so that's why i kind of turned it 129:21 to you what what do you think 129:24 the city as a whole should be doing if 129:26 if and when this happens or 129:28 if the worst is to happen right i 129:31 understand what you're saying 129:32 um what we're doing right now is we're 129:35 looking at all of the cases that we have 129:37 right now 129:37 we're looking at any outstanding debt 129:39 that we have right now 129:41 and determine how much we can bond for 129:44 depending on 129:45 if any of the cases that's out there um 129:48 what would happen we will have to start 129:51 looking at this case in particular 129:53 um so i want you to know you may not 129:56 hear 129:57 anna and i uh not talking about it out 130:00 in public but we do look at where we are 130:03 what we can bond 130:05 how we need to move forward um on 130:08 everything that we have so i understand 130:10 your question 130:11 i just want you to know that we are 130:13 taking 130:14 all things under consideration how we 130:16 move forward 130:19 okay that's nice to know but unlike the 130:22 other cases 130:23 we already lost this one donna this 130:26 isn't 130:26 in litigation we lost it liability we 130:29 have to look at damages 130:31 so we still have to look at what the 130:33 potential could be and how we would take 130:36 care of it 130:38 yes that's that's what i'm asking for 130:40 that's what i've been asking for for 130:41 three years 130:42 oh okay okay i'm i'm glad to know that 130:45 something's being done 130:46 yeah we're looking at everything roy 130:49 believe me okay 130:50 okay thank you 130:53 okay who's next dave 130:57 uh next is judy vining hi judy 131:05 judy go ahead on you yourself unmuted 131:09 just quick first of all i'm thrilled and 131:12 excited to be on the 131:13 public safety commission board i think 131:15 that long beach aware 131:17 really deserves a place or a voice at 131:20 least there 131:22 and for a while i'm part of long beach 131:25 where that's 131:27 who'll be but in terms of that 131:30 not so thank you 131:34 my other question is more procedural we 131:37 have 131:38 ordinances and we have legislation that 131:42 really needs to be discussed and can't 131:45 be discussed 131:46 in three minutes um public 131:49 you know comments we have to sit down we 131:53 have to work and how do we do that 131:55 how do we look at our social host 131:57 legislation 131:58 knowing we need to really quickly add 132:02 marijuana to it because of the way the 132:04 state is going 132:06 um what would be the process 132:10 you guys suggest because three minutes 132:13 of good and welfare doesn't do it 132:16 so what what i would suggest and not 132:20 that i want to put 132:21 more things on her plate but would be to 132:23 make an appointment to meet with 132:24 with the city manager to discuss it no 132:27 we have met but 132:28 it's really a procedural question i 132:30 think for 132:31 for the council because the council 132:34 enacts the legislation 132:36 um and we've done it before it's not a 132:39 new thing 132:41 at all my question is 132:44 where do we find a place or a way 132:48 of sitting and talking and hashing it 132:50 out 132:54 uh again well whether it's 132:57 getting in a room or whatever the the 133:00 city manager's office would arrange 133:03 any meetings or anything like that 133:06 i mean you know it's public business 133:07 it's not you know 133:09 it's nothing secret it's not anything 133:11 like that it's just that 133:13 well if you want to do it in a public 133:15 forum i mean we could 133:17 we could potentially do it at a working 133:19 meeting or something like that 133:20 right because it's just about i mean 133:24 it's not even um 133:25 an adversarial thing it's something that 133:28 the city of long beach got 133:30 tremendous nationwide credit 133:33 for being or at least statewide credit 133:36 for being the first 133:38 in the state of new york to enact a 133:40 social 133:41 host ordinance and then when we realized 133:43 we needed to 133:45 up the ante in terms of fines and 133:48 scott i'm sure you'll remember that and 133:51 then we met as a subcommittee 133:53 and then brought it to the council so 133:56 it's 133:58 you know the other the other place to 133:59 potentially do it too 134:01 is that you're on the public safety 134:03 committee that might also be the place 134:05 to 134:06 have it bubble up from there well it 134:08 could but 134:09 the point that i'm trying to make is 134:12 that 134:14 within weeks from everything i hear from 134:16 all the state committees i'm on 134:19 this is going to be a major issue in the 134:21 state of new york 134:22 if we don't get ahead of it locally we 134:25 will be 134:26 constrained by whatever 134:30 the state legislature and the governor 134:32 want 134:34 correct correct me if i'm wrong but 134:36 hasn't nassau county already passed 134:37 legislation banning uh 134:40 marijuana even if the state passed it 134:43 yeah but we're in a new um 134:45 it did last 134:48 it did the last legislative session but 134:50 it's we're in a new ballgame now 134:52 it doesn't matter what um nassau county 134:56 passed 134:57 and we didn't pass it as a city 135:01 we wouldn't fall under the county 135:03 legislation 135:04 last time we didn't have a right as a 135:07 city 135:08 to do the carve out the county did but 135:11 we did not 135:12 and the county did not cover us okay and 135:15 that's your three minutes you know again 135:17 i'm i'm not an attorney and believe me i 135:19 don't want to keep doing this 135:21 neither am i so but yeah so like i said 135:24 we need a form to do it we need a way to 135:27 do it so that when we were able to be 135:31 lauded for everything we're able to 135:33 accomplish okay so we could talk offline 135:35 and maybe we'll 135:36 we'll we'll do it at a working meeting 135:37 then a public working meeting 135:39 great okay 135:42 okay and the thing i want to throw at 135:44 everybody 135:45 is god help us we're having our first 135:48 virtual 135:49 breakfast of champions and prevention 135:51 isn't always about 135:54 alcohol and other drugs sometimes it's 135:56 about preventing hunger 135:58 and so anything and everything that 136:01 we're going to do 136:03 in terms of proceeds from our virtual 136:05 breakfast of champions that we do every 136:07 year 136:08 where we feed people the money is going 136:11 to 136:12 our weekend feed in conjunction with the 136:16 school district and 136:17 blah blah and trader joe's and i would 136:20 encourage everybody 136:22 it's give us whatever you want it 136:25 doesn't matter 136:26 give people the website the website is 136:29 www 136:30 long beach aware dot org donate button 136:34 and there's a drop down menu it's 136:36 weekend feed or breakfast 136:38 of champions but again we you know 136:41 long beach is great for its breakfast 136:43 right you know we know the 136:46 we know how we do it but this thing 136:48 we're doing with that food 136:50 every penny is going to try to 136:54 keep going with the weekend food and we 136:56 were able to do that from 136:57 june to september with the help of all 137:01 of the people 137:02 that we're honoring it's on facebook 137:05 it's all over the place 137:06 and um if the technology doesn't crash 137:10 we would 137:12 certainly welcome i sent you an email 137:14 john 137:15 well over your three minutes can you 137:16 please wrap it up 137:19 and that's why we need more than three 137:21 minutes 137:24 okay all right thanks judy you're 137:27 welcome 137:28 all right next is paul fetch fetcher 137:33 okay hey paul 137:40 you gotta mute paul 137:43 hi there okay thank you john i'd like to 137:47 uh yield my time to eileen hession she 137:49 wasn't a cue but her 137:51 laptop battery died so here's eileen 137:54 all right okay thank you 137:58 i'll try to keep within my three minutes 138:01 a couple of questions i'll put them all 138:03 together 138:04 the first one is we listened to the 138:06 police commissioners a couple of weeks 138:07 ago 138:09 when will we have the decision on that 138:12 the second is about covid 138:16 i appreciate it john turn this off 138:19 i appreciated john giving us the 138:21 information at the beginning of the 138:22 meeting but i'm wondering if those 138:26 cases are mild or have there been deaths 138:29 in long beach 138:30 and also where are those big numbers 138:33 coming from 138:33 are they house parties the bars the 138:36 schools 138:37 the old age homes and 138:43 are the police taking care of 138:46 you know if bars are overcrowded or 138:48 whatever 138:49 that's about covered the next thing is 138:51 about the rallies 138:53 at kennedy center most of them 138:56 are being held by people who don't even 138:58 live in long beach 138:59 i'm wondering if they have permits and 139:02 if we are having to pay the police 139:03 overtime 139:04 in order to you know monitor those 139:06 things 139:08 um next 139:11 parking meters have been brought up so 139:13 often but no decision has ever met 139:15 meant done on them and finally i was 139:19 glad that the haberman was brought up 139:21 and something is being done about it we 139:23 also have 250 years 139:26 of police retirements right now and 139:29 that's another huge amount of money 139:31 and i'm wondering how we can address 139:34 that i don't think that will be answered 139:37 tonight but maybe some of my other 139:38 questions 139:39 will thank you very much 139:46 and they don't hear me all right uh yeah 139:48 we heard you uh 139:50 hello donna you wanna i i jotted him 139:53 down i think i got him 139:54 so okay what's the first one police 139:56 commissioner when we expect uh 139:58 hopefully within the next week two weeks 140:01 at the most 140:03 okay uh covid i guess 140:06 uh and eileen we we've run into this 140:09 before the 140:10 the that information that you're talking 140:13 about which is a lot of it is 140:15 where is it occurring and the severity 140:17 and things like that 140:18 that's data that the county department 140:20 of health collects they do not share 140:22 that with the city 140:24 um dude very 140:27 well john's on so i'll let john go 140:29 because he's the one that's 140:30 monitoring this yeah and it's it's not 140:32 even just that the the 140:33 county doesn't have it the county has a 140:35 certain granularity of data but it's the 140:37 state department of health that captures 140:39 all of it i mean some of this is 140:40 protected by hipaa 140:41 right like so that's severity of cases 140:45 where the location is if you're giving a 140:47 location and you're potentially giving 140:48 away 140:49 who the person was that tested positive 140:51 or has a case 140:53 literally the only the only information 140:55 that we have access to we have 140:57 requested additional layers of 140:58 information but the only information 140:59 that the city 141:00 can gain access to um is 141:04 you know the absolute numbers and the 141:05 smooth that average of positive tests 141:07 we don't know the percent positivity as 141:10 i mentioned earlier we don't know the 141:12 locations 141:14 there was during um 141:18 the the spring spike there was 141:21 confidential downloads into our first 141:23 responders so police and firefighters 141:26 you know was a blind entry into their 141:28 system 141:29 so if they responded to a house that had 141:33 a known 141:34 positive case they were alerted to it um 141:37 but they would not have known until they 141:38 actually 141:39 showed up in the system alerted to me 141:41 even that didn't have names it was 141:44 physical addresses and it was for their 141:45 safety but you know 141:47 in terms of severity you know and where 141:50 we just don't have that information in 141:51 terms of enforcement 141:53 our police department is absolutely 141:55 enforcing it 141:57 and some of the good news is um 142:01 they were recently we just the police 142:02 department knew this but during a recent 142:04 executive order 142:06 the governor um has allowed local 142:09 ordinances to come and play 142:10 in order for mask violation and other 142:12 things so 142:14 part of the difficulty earlier on was 142:16 enforcement men 142:18 issuing a violation of executive order 142:20 which is a class b misdemeanor which 142:22 means that people are arrested and very 142:25 severe 142:25 you know fiscal financial penalties 142:28 associated with it too 142:29 so now they have more flexibility in 142:32 terms of 142:33 what the hammer is for enforcement and 142:35 it's not so extreme so that they can use 142:37 more latitude 142:38 um because obviously if there's one 142:40 person walking down the street and they 142:41 weren't wearing a mask 142:42 you don't want to arrest that person um 142:45 you know you reserve that for really 142:46 egregious acts 142:47 now our police department has a little 142:49 bit more latitude with 142:51 additional guidance from the state john 142:53 very simply 142:54 we've had over a thousand cases within 142:56 the city of long beach 142:58 how many deaths have we had we don't 143:01 have access to that information 143:03 okay okay 143:07 all right uh next was about the rallies 143:09 in kennedy center and i guess 143:11 eileen you sound like it was more of a 143:13 statement than a question because you 143:14 said most of them were from out of town 143:16 and are we playing for the police 143:18 overtime for them commissioner 143:20 is on is he still on yes okay 143:24 and there he is i'm new 143:28 hi how are you yeah so 143:31 we've been monitoring all the other 143:33 rallies we've had in kennedy plaza 143:35 and we're doing with on-duty police 143:37 officers so 143:38 there's been no overtime uh we we had 143:41 one today actually uh that we we 143:44 monitored and we were at but 143:46 um we've done it without uh incurring 143:48 any cost 143:49 and there's been really no disruption uh 143:52 to the city 143:53 uh we've allowed people to verbalize 143:55 what they want to say 143:57 uh and and exercise their constitutional 144:00 rights but 144:01 at the end of the day it hasn't cost the 144:03 city any money as far as 144:04 police over time 144:08 if i may i had to leave my office 144:09 tonight because of loudspeakers they 144:11 were talking about 144:12 buttholes and cheers of four more years 144:16 that i had to leave my office i would 144:17 consider that a disruption 144:19 that was uh shortly after about 505 this 144:22 evening 144:23 yeah um i was there at 505 and there 144:27 were probably about 144:28 15 people there and they they 144:31 did speak and they were rallying with 144:34 flags but 144:35 um it was not disruptive all right 144:42 uh next was about parking meters and 144:46 we can probably blame that in mike 144:48 delorey because 144:50 he likes parking meters uh but uh 144:54 john and ena can update where we are 144:56 with parking meters 144:58 so that's what ian and i sat down with 145:00 um 145:01 our existing parking consultant to 145:03 review some of the numbers 145:04 uh we requested additional information 145:07 um 145:08 both in terms of you know backing up the 145:11 data that he was able 145:12 that he used to uh base his assumptions 145:15 on 145:15 for what the pro forma would be for 145:18 installation of parking meters in our 145:20 central business district 145:22 um so we we're continuing down the 145:25 process and we're evaluating it 145:26 um you know it's it's been discussed for 145:30 20 or 30 years we've been out we've been 145:32 at this for about six months so a little 145:34 bit of patience but we can we continue 145:36 to pursue it 145:39 okay okay and the last two i eileen i 145:42 don't know if i 145:42 uh if i got a question out of here for 145:45 you just more expressing concern about 145:47 haberman and all the police retirements 145:49 the the potential financial implication 145:53 is that what you were yeah i'm concerned 145:55 about that yes 145:56 okay i mean yeah i don't know what to 145:59 say i mean 146:00 our police officers deserve their 146:02 retirement but i don't know how we can 146:03 sustain it 146:06 well we do have i mean obviously 146:10 the police officers retiring now or like 146:12 you said they're they're entitled to 146:14 what they're 146:15 entitled to um the the police 146:18 arbitration that was just 146:20 the binding arbitration that just went 146:22 through 146:23 does put a cap on 146:27 what retiring police officers can get 146:30 going 146:31 forward what was the effective date on 146:33 that uh 146:35 rich retiring i think uh what you're 146:38 referring to is that the cap applies if 146:40 it won't apply if they leave on or 146:42 before a certain date so they'll be it 146:43 was on it before the end of the year 146:45 right or something like that or was it 146:46 december sometime in december 146:48 i forget the exact date but the 146:50 arbitration award essentially says that 146:52 um the cap applies prospectively but if 146:55 uh if officers leave and put their 146:59 papers for retirement and before a 147:00 certain time they're entitled to their 147:01 other payout 147:02 right originally i think 147:05 i think it was in december but does it 147:08 as a date before the end of the year 147:10 that after that point the 147:14 uh police retirement uh 147:17 the amount they're allowed to get paid 147:18 out is capped 147:20 at 275 000 147:24 which if you follow 147:27 you know which i know you do eileen the 147:29 police retirements you know that's 147:31 significantly lower than what many of 147:33 them get 147:34 um so that's the cap now so it's the 147:37 idea is that 147:38 um uh i assume the incentive was 147:42 the idea was not to let people build up 147:47 uh huge amounts of vacation that exceed 147:49 the contracted amount and comp time and 147:52 and and other things and and keep people 147:55 within the 147:56 the limits that they they're supposed to 147:58 be kept in 148:01 also um the ones that are retiring now 148:04 they receive their payouts over 148:05 uh years it's not all at one time 148:09 uh correct yeah they are spread out now 148:14 uh just to finish up thank you very much 148:16 for all those answers 148:18 um my pet peeve is hell but still is a 148:22 dangerous 148:23 area over there with broken glass and so 148:25 forth 148:26 and i hope that we are finding the 148:30 owner of the property and also the 148:32 hospital 148:33 is a dangerous place and south nassau is 148:37 building now 148:39 and i think it's really outrageous that 148:41 all of 148:42 most of our politicians have agreed with 148:45 what the hospital is doing when they 148:47 took 148:48 all of our money and are building a 148:50 bunch of doctor's offices there 148:52 and uh destroying a neighborhood really 148:56 so and looks like nothing is going to be 148:59 done 148:59 but while they're doing their work there 149:01 are no street lights on state street 149:03 right that's your time 149:06 oh yeah okay all right thanks eileen 149:10 yeah all right dave 149:13 uh brendan healy oh hey brendan 149:18 oh wait i'm having a technical issue 149:20 here hang on one second 149:22 okay brandon i got to bring you up to 149:25 the panel because you're using an older 149:26 version 149:28 so let's give this a shot 149:43 i just lost 149:51 you lost them i lost them i promoted 149:53 them and uh 149:54 i guess he he looks like he dropped off 149:56 uh 149:58 hang on i may have his number i might be 149:59 able to text them 150:09 all right i just told him to call back 150:11 in uh well 150:12 why he's doing that is there anyone else 150:14 i hope that was it oh that was it 150:16 all right well we'll give him a couple 150:18 of seconds to see if he uh 150:22 comes back in mike sing us a song while 150:24 we're waiting for 150:25 uh brendon 150:32 [Music] 150:34 you're muted mike 150:37 you didn't hear it john oh that's a good 150:40 thing he's 150:40 muted 150:44 all right i mean i guess uh i can give 150:46 brendan a call and find out what it was 150:48 uh because uh it doesn't look like he's 150:51 coming back in 150:52 yeah i don't i don't see him showing up 150:54 on on any list okay 150:56 well i do have no wait wait he just 150:58 texted me back he says he's 151:00 coming in now all right i do have 151:01 another hand in the meantime 151:03 um deborah marino okay 151:07 go ahead deborah hi deborah 151:10 hi hi hi can you hear me 151:14 yes we can okay well thank you guys this 151:17 is my 151:18 first um meeting i've gone to so oh 151:21 welcome very enlightening thank you 151:24 um and and thank you all for expediting 151:28 all the uh 151:29 stuff with the rinks and the swimming 151:31 and everything because 151:32 i have kids and especially the ice rink 151:35 has been very important so 151:37 um you know that you got it open so at 151:39 least they could do sticks and pugs and 151:40 stuff and 151:41 um i do have a quick question though 151:45 for i don't know if i heard it wrong or 151:47 i just didn't understand it 151:49 um the rf like the bidding stuff 151:52 is that again occurring in april 151:58 i i think you're referring to the the 152:01 other rfp 152:02 that's going out for the ice arena and 152:04 rich i don't know if you want to 152:06 explain that one right and is that also 152:09 for the swimming not just the rain no no 152:11 that's just for the ice arena 152:13 all right okay uh president bender you 152:15 hit you hit the nail on the head um 152:18 so uh miss mourinho this is essentially 152:20 an rfp a request for proposals that will 152:22 be forthcoming 152:23 regarding the operation of the ice arena 152:25 only and that's 152:26 that's to come in the future not it 152:28 doesn't have to do with the uh 152:31 oh okay now when 152:35 okay so every april this is 152:39 a common thing or this is just this year 152:42 because of covet or 152:44 well yeah this year has been a little a 152:46 little odd because of 152:48 of covid so um 152:52 so for example some of the things you 152:53 saw tonight is 152:55 um some of the vendors that were 152:59 operating in the ice arena and the in 153:01 the pool 153:04 hadn't gone through a proper uh rfp 153:07 process and didn't have the right kind 153:09 of contracts and things like that 153:11 so while the places had to be closed 153:15 because of the covet case 153:16 we we used that opportunity to take that 153:19 and then 153:20 get everybody current and proper with 153:23 the 153:23 with what the procedures are supposed to 153:25 be so what you saw tonight now 153:28 was us making all the vendors for the 153:31 swimming 153:32 and and the ice uh stuff the leagues 153:35 now they're all going to be done all the 153:38 contracts will now be proper 153:39 and everybody's going to have their 153:40 insurance and things like that 153:43 so um so that that's 153:46 that's basically uh there's a renewal 153:50 in there right uh 153:53 and they'll be in the contract usually 153:55 so it 153:57 so no it might not necessarily be an 153:59 annual thing it 154:00 it depends um on the final contract 154:03 sometimes there's renewals in there uh 154:06 at the city's discretion 154:07 so 154:11 oh okay just curiosity how come 154:14 it's just on the rink and not for 154:17 swimming or 154:18 anything else so the separate one 154:21 is the uh 154:24 the ice arena um 154:27 [Music] 154:28 is quite frankly uh 154:32 physically is in needs a lot of work 154:35 um more than the city quite frankly 154:38 could 154:38 probably afford to do um 154:42 so some there there is uh the idea is to 154:46 uh put out an rfp to see if a 154:49 larger operator quite frankly with some 154:51 deeper pockets can come in and 154:54 uh get the ice arena uh back up to 154:57 back up to good condit you know where it 155:00 really should be 155:01 and and operated for the city because 155:04 again there's 155:05 there's a lot of expense to the city 155:07 operating that ice arena 155:10 if we can still have that ice arena 155:12 going 155:13 but have it done by a vendor that you 155:15 know 155:16 uh basically will pay the city rent uh 155:20 that that's good for the tax phase i'll 155:22 give you just a four example 155:24 to keep the ice frozen in the arena cost 155:26 the city fifteen thousand dollars a 155:28 month 155:29 to keep the ice frozen oh um 155:33 it's it's expensive and like i said the 155:36 building needs a lot of work 155:37 uh quite frankly it's 155:41 it's kind of it's old and it needs to be 155:43 updated 155:44 so um if we can get um 155:47 you know somebody that operates other 155:49 ice arenas to come in 155:51 and uh and take over operating it and 155:54 and do some of the upgrades that are 155:56 needed and run some good programs 155:58 it's a win-win for everyone so the 156:02 the current status doesn't meet the 15 156:05 000 rent each month like the city takes 156:08 some of that is what you're saying 156:10 um actually i'm not i don't i 156:14 rich man i don't know what the current 156:15 you know the the various hockey leagues 156:17 and stuff pay for 156:19 for rent and things like that i don't i 156:21 don't have that information i'm just 156:22 saying it's 156:23 the the ice arena from my understanding 156:26 and 156:26 yeah ian is still here i think the ice 156:28 arena generally runs 156:30 uh at a loss for the city so 156:33 uh the idea is to get the ice arena 156:37 keep it running but uh you know 156:40 hopefully with somebody that can run it 156:42 more 156:44 i don't know business like is the term 156:45 but at least can can 156:47 run it properly and it's not a a loss to 156:50 the city 156:53 would there ever be a time where it just 156:57 then closes and the teams and all the 157:00 kids don't get to 157:01 use it for teams uh we hope not that's 157:04 we certainly would not like to see that 157:06 happen 157:06 uh mr bill would you like me to jump in 157:08 on this sure joe if you got 157:10 info sure um ma'am so basically you know 157:13 uh 157:14 what mr bender was alluding to and 157:16 mentioned 157:18 the city's goal in releasing this 157:20 upcoming rfp 157:21 is to have you know as he said um really 157:25 think of it in terms of a specialist you 157:26 know um an entity that specializes or 157:30 has a lot of knowledge in running a 157:32 large-scale ice rink 157:33 and the ultimate goal is that any 157:36 repairs that might need to be made to 157:37 the building 157:39 really to make it a better facility for 157:41 the public and 157:42 our children where the longevity of the 157:46 ice arena 157:46 will you know last into you know 157:50 many years into the future with respect 157:52 to um what you said earlier about you 157:54 know um 157:55 the swimming and whatnot and some of the 157:57 other rfps i'm not sure if you may be 157:58 confusing um 158:00 the difference between just the ice 158:01 arena rfp which will be you know uh 158:04 we're in the process of uh finalizing 158:06 and and working out all the terms of 158:08 that 158:08 as opposed to some of the recreational 158:10 activities where 158:12 um as uh donna had mentioned before 158:15 being that those were approved we will 158:17 be in touch with people you know this 158:19 week 158:19 in order to finalize um some of the 158:21 smaller recreational contracts as 158:23 opposed to the ice arena which is such a 158:25 vast undertaking 158:26 we're not looking to um get out of 158:28 anything where you know after a number 158:30 after a couple of years we just walk 158:31 away from the ice arena we're actually 158:33 looking to 158:34 make it that the ice arena is repaired 158:36 it's a fantastic facility and that it 158:38 sticks around in our community for a 158:39 long time 158:40 yep okay all right great so so you're 158:43 looking out for the kids and all of us 158:46 oh yeah the goal is to make this thing 158:48 survive for the long term 158:50 good and and short term while we're 158:52 looking for the long term 158:53 right okay good all right excellent well 158:56 thank you so much 158:57 all right have a good night and i say mr 158:59 healey is back 159:02 can you guys hear me now yes we can okay 159:05 hey sorry about that um so a couple 159:08 things i i just wanted to 159:10 first of all um you know is now i guess 159:13 a member of the public safety commission 159:14 i just i just want to thank donna 159:15 and gina guma specifically i know 159:17 there's a lot of work 159:19 that went into getting these boards and 159:20 commissions up and running and obviously 159:22 going through the interview process 159:24 you know it was it was very thorough and 159:26 also what i think very thoughtful 159:28 um so just want to make that comment and 159:29 say thank you very much for 159:31 putting that together i know there's a 159:33 ton of work and i'm very happy as a 159:34 resident to 159:36 to see these commissions and boards and 159:38 um advisory groups uh back up and 159:40 running 159:42 thanks so that was my first part um i 159:45 have one quick 159:46 item well not me it's not quick but now 159:49 this is west end neighbor civic 159:50 association 159:51 shift gears quickly so 159:54 as many of you know west end neighbors 159:56 we work with 159:57 licensed establishments in the west end 159:59 anyone holding sla license renewals 160:02 permits etc so three updates for you the 160:05 first 160:06 is five ocean bar and grill that's on 160:09 the corner of 160:10 new york avenue over by the boardwalk 160:12 there they are going to be going in 160:14 front of the 160:14 state liquor authority full board and 160:16 that's going to happen on december 160:19 8th public comment has to be back to the 160:21 sla by december 4th 160:23 we've been working with that applicant 160:25 for several months now 160:27 we've heard a lot of comment and 160:29 feedback from the residents at 780 160:31 west broadway not because they're so 160:33 concerned about the establishment having 160:36 a full liquor license 160:37 but because they're concerned about the 160:39 establishment creating noise that 160:41 impacts 160:42 the quality of life in that building 160:45 again we are 160:45 working with the establishment right now 160:47 hoping to come to an agreement before 160:49 december 8th 160:50 but if not we'll provide comment as we 160:52 do to the liquor authority 160:53 and ask for certain stipulations 160:54 regarding noise hours of operation that 160:56 sort of thing 160:58 second update is long beach culinary 161:01 concepts 161:02 this is the ugly duckling over on west 161:05 beach street 161:06 we've received a lot of questions and 161:08 comments around this establishment 161:10 the liquor authority approved their most 161:13 recent license 161:14 adopted the stipulations they were 161:16 agreed to by the west end neighbors as 161:18 well as the applicant 161:20 however in their initial application 161:23 the applicant did not request the use of 161:26 a dj 161:27 so what's happened is they went back in 161:29 front of the sla for reconsideration 161:32 long in the short of it is uh they were 161:34 not granted use of a dj 161:36 uh it looks like they will not be able 161:37 to have a dj until the state liquor 161:39 authority 161:40 um approves their application or reviews 161:42 it again which probably won't happen 161:43 until next summer 161:45 and last but not least is the cafe which 161:48 is 161:49 used to be formerly island time across 161:51 from neoposto on the corner of west 161:52 beach and new york avenue 161:54 um they apply for a beer wine and cider 161:56 permit 161:57 we met with them as well good dialogue 161:59 conversation with the community 162:01 they are now asking for a full liquor 162:03 license um 162:04 and we are in discussion with them um 162:07 but again 162:08 you know we're seeking comment from the 162:09 community so if anybody has any comments 162:11 please send it to west end residents 162:14 at
