get started 01:16 we have two items that were um proposed 01:18 to be added by unanimous consent 01:21 and i get a motion from from from 01:22 someone to add items 01:24 six and seven to the agenda council 01:53 just for clarity item six is a 01:56 resolution amending the city's agreement 01:57 for construction 01:58 of an office of emergency management and 02:00 to amend the budget and item seven is a 02:02 resolution authorizing the city manager 02:04 to renew the city's agreements for 02:05 disaster management response 02:07 and recovery consulting services 02:14 okay uh with that i guess uh 02:17 we'll go to the city managers report 02:21 good evening all thank you very much um 02:24 we have been really 02:25 busy working um on the beach 02:29 um policies procedures checking the 02:32 beach and checking the boardwalk 02:35 so what i'd like is um 02:37 [Music] 02:38 commissioner ragona to speak first 02:41 and then right after him will be um 02:45 joe brand commissioner joe brandt 02:50 thank you donna um good evening 02:53 everybody and 02:53 thank you for having me here tonight uh 02:55 to speak a little about some changes 02:58 and some modifications which can be 03:00 occurring shortly 03:02 there are two major changes that we have 03:05 going on 03:06 and i'll address them separately and 03:08 explain the reasoning behind it 03:12 firstly uh let me talk a little bit 03:14 about the 03:15 sale of non-resident daily beach passes 03:20 several weeks back we had talked about 03:23 it 03:23 and came up with a plan to begin selling 03:26 non-resident daily beach businesses in a 03:29 limited amount of areas 03:32 we uh we're the mindset that the center 03:34 of town was traditionally 03:37 uh out of town is coming in and so we 03:40 would limit 03:41 the sale of non-resident daily passages 03:44 from 03:44 laurelton long beach boulevard those six 03:48 speeches 03:50 what we've come to see is that they are 03:52 reaching capacity 03:54 early and it's becoming a bit of an 03:58 issue with that 04:00 certainly on the weekends but in the 04:02 weekdays um 04:04 we felt we were turning away our 04:06 residents from those beaches 04:08 because they were capacity and 04:11 it was an issue with simply socially 04:14 distancing 04:16 those that were on the beaches from 04:17 laurelton long beach boulevard 04:20 with that being said effective this 04:23 friday 04:24 the 24th of july um non-resident 04:28 daily beach passes will no longer be 04:30 sold on friday 04:32 saturday and sunday which are the times 04:34 in the days that we have traditionally 04:36 become 04:37 saturated with uh train crowds 04:41 non-residents and the beaches have 04:43 reached capacity very early 04:45 and have become a bit of a safety issue 04:48 through thursday 04:50 the non-residents will still be able to 04:52 purchase their 04:53 daily passes in those locations and 04:56 those limited locations still 04:58 between laurelton and long beach 05:00 boulevard 05:02 we have to think of safety and we have 05:04 to think of our residents 05:06 which obviously is an important matter 05:09 the second issue 05:11 uh and the second modification that 05:13 we've made to some um 05:15 long-standing practices and uh 05:17 ordinances in long beach 05:19 are the hours of beach park we've 05:21 allowed beach park to stay open from 5 05:23 a.m 05:24 to 11 p.m oh 05:27 it's been in uh in our code of 05:29 ordinances it's been an uninstable code 05:31 um due to the fact that we have now 05:35 seen a trend of very 05:38 large unruly disorderly 05:42 anti-social not safe safely socially 05:46 distancing groups 05:48 certainly we've all heard about this 05:49 saturday when it really came to a head 05:52 with 05:52 800 900 young adults men and women 05:55 coming to the beach 05:57 um drinking fighting smoking marijuana 06:01 absolutely not safely socially 06:03 distancing 06:05 and it occurs at the night in the 06:07 evening hours 06:08 uh they've come down to our beach in the 06:11 center of town traditionally 06:13 um and created chaos and we've we've all 06:15 seen 06:16 what happened uh this last saturday 06:20 in response to that we felt it was the 06:23 safest thing to do 06:24 is to close the beaches the beach 06:27 not the boardwalk first but the beach at 06:30 8 p.m 06:32 um it's gonna be a big task but we can 06:34 do it 06:35 at 8pm we'll shut down the beach itself 06:38 and we'll do it with 06:39 police officers i will be assigning and 06:41 i have been assigning 06:43 uh seven nights to week i have regular 06:44 police officers on the beach now 06:47 uh they are augmented by our special 06:50 police officers 06:51 we're also augmented by our beach 06:53 maintenance and our lifeguards 06:55 um along the beach systematically 07:00 down the boardwalk uh on the beach area 07:02 between neptune 07:03 boulevard and new york avenue and we 07:06 will give a warning 07:08 around 7 45 p.m and then 07:11 we'll make it we'll circle back and then 07:13 by 8 pm we will 07:14 move beach to beach and move the crowds 07:18 off 07:19 the boardwalk itself will not close 07:21 until 9pm 07:23 and at that point uh specials 07:27 my bicycle police officers who i will 07:29 have up there 07:31 it just can't be done by specials we 07:33 need police officers also obviously you 07:35 need 07:35 real teeth to it and that is not meant 07:38 in any way to be disrespectful to 07:39 specials to do a great job 07:41 there are certain jobs that you need a 07:43 police officer at 07:44 so we'll have uh four bicycle police 07:47 officers 07:48 uh four or five special officers 07:51 we'll have a smart car up there joe 07:54 brand will speak 07:55 a little bit but he's gonna have his 07:56 guys on a gator and we will start off at 08:00 edwards boulevard 08:01 and again systematically move east and 08:04 west 08:05 telling people that they're at nine 08:06 o'clock that they have to exit the 08:08 boardwalk 08:09 and we will some people may have to walk 08:11 a little further east or west 08:13 um to get to where their car is we will 08:15 follow them through 08:17 as we move the group off edwards or 08:20 national or riverside in conjunction uh 08:23 with tommy kenner and his uh beach 08:26 maintenance guys 08:27 they will then gate off the entrances to 08:29 the boards 08:30 and we'll continue to move down so we 08:33 get to neptune and new yorker avenue 08:36 my feeling is ultimately you will have 08:38 stragglers it's inevitable 08:41 someone who you didn't get off the beach 08:42 someone who's 08:44 so we will continue to have the gator 08:46 and the um smart car 08:47 going back and forth we will assist 08:50 there may be an older couple who 08:52 need to get off we will leave edwards 08:54 boulevard 08:56 ramp open not gated off but we will have 08:59 a security officer stationed in not 09:02 allowing anybody else on 09:04 but it will be an egress an area for 09:07 them for people on the boardwalk 09:08 to get off if necessary it is 09:12 absolutely a work in progress um 09:15 i think we have a really good plan 09:19 um we have been speaking almost ad 09:22 nauseum 09:23 between uh the city manager myself 09:26 uh joe brand tommy canna 09:29 um we are all on the same page i believe 09:32 most of us will be there at 09:33 9 00 8 o'clock i know i will on on 09:36 uh on thursday night to see how we kick 09:39 this off 09:40 it's necessary it's really important 09:44 and if we don't do this now i really 09:47 believe there could be dire consequences 09:49 down the road 09:50 um so it's people think it's drastic i 09:54 don't i think it's necessary 09:56 and i just want to note one more thing 09:58 which just came to light 10:00 today and i'm not sure if everybody's in 10:03 the loop 10:03 maybe uh we've been advised that the 10:07 foundation block which is between 10:09 edwards boulevard 10:11 and riverside boulevard i get killed a 10:12 dirt lot which is a privately owned lot 10:15 and the owner has graciously 10:19 uh for many many years allowed us to um 10:22 off cause department and they pocket 10:24 their own risk it's a private lot 10:26 um we found out today that that no 10:29 longer will be available to us 10:32 and that lot will be effective 10:35 immediately 10:36 shut down to um motor vehicles parking 10:40 i have already spoke to my sign shop 10:43 they are in the process 10:44 as we speak of fabricating signage 10:48 we will go around the entire area 10:51 from edwards down east broadway 10:55 and back against south on riverside 10:58 indicating the same 10:59 uh there's an issue with towing the 11:01 cause it is private property 11:03 when we do get an authorization from the 11:05 owner of that property 11:07 that he gives us authority to tow then 11:09 it'll give us a little teeth to take 11:10 cars out of there 11:12 but the signage stating that it's 11:15 private property 11:16 no parking lbpd will go up 11:20 um it might not be a terrible thing 11:22 right now for us 11:23 with us avoiding cars coming to the 11:26 center of town 11:27 but it's it may be an issue down the 11:29 road moving forward to next season and 11:31 it's something we should be aware of 11:34 and that's kind of where i'm at right 11:35 now uh any of you have questions for me 11:38 in regards to our enforcement 11:40 how we're going to implement this uh 11:42 policy 11:49 yes no hi this is oh sorry 11:52 this is liz i just wanted to thank you 11:55 and everyone at the department 11:57 for your extremely professional and hard 12:00 work over the weekend and 12:02 the days that you have taken over this 12:05 position 12:06 that's very gracious liz thank you it's 12:08 uh truly i know this may sound corny 12:11 i've worked here 34 years it's my honor 12:14 and my pleasure 12:15 and i am proud to be able to leave the 12:18 department during these times and the 12:20 trying times 12:21 and it's certainly no time for on the 12:23 job training here so 12:25 i believe the institutional knowledge is 12:27 important and um 12:28 i'm very proud of the offices and 12:30 specials in the whole department and 12:32 thank you for your kind words 12:40 okay uh is there any questions from the 12:43 council 12:43 [Music] 12:46 okay uh back up city manager is uh there 12:50 mo 12:50 do you have money your report um yes mr 12:53 brand 12:58 good evening everybody um i'd like to 13:01 begin 13:02 just by addressing some of the stuff 13:04 that's happening at the wreck 13:05 first uh before i piggy back some of the 13:08 stuff that went on uh over the 13:10 weekend with the ocean beach park and to 13:12 kind of pick up where 13:13 phil left off at the wreck 13:17 as we speak the men's league softball 13:20 has begun 13:22 looking forward the municipal pool will 13:24 open on august 3rd that's a week from 13:26 monday 13:27 a kids baseball program will begin that 13:29 same day 13:31 the ice arena has secured the contract 13:33 to have the ice reapplied the weekend of 13:35 august 1st 13:37 and uh effective tomorrow the sprinkler 13:39 park hours are going to be extended 13:41 thanks to this oppressive heat and 13:44 lastly 13:45 we've recently secured community 13:47 development and economic development 13:49 funding thanks to patty bourne 13:51 that funding is earmarked specifically 13:53 for senior programming 13:55 to be done virtually out of two separate 13:57 places 13:58 one out of the senior center and the 14:00 other out of mlk 14:02 so thank you patty for putting that 14:04 together and 14:05 allowing us the opportunity to help a 14:08 and 14:08 an area of our community that could 14:11 certainly use uh 14:12 some activity in their life um 14:16 picking up again where phil left off 14:20 again this weekend our neighbors from 14:21 the east jones beach 14:24 uh town of hempstead nassau county 14:28 shut down all of their operations with 14:30 the beaches by 10 am 14:32 we were inundated on saturday we were 14:35 able to 14:36 pretty much stable off most of the crowd 14:37 until real late in the day saturday 14:39 and we kind of survived and got through 14:41 the day 14:43 sunday we weren't quite as lucky the 14:44 crowds arrived much earlier 14:46 arrived much heavier and when it was 14:50 decided upon by uh 14:52 police personnel beach park personnel 14:54 and lifeguard personnel 14:56 that it was time to shut the beaches 14:57 down in the center of town it was about 14:59 1 p.m 15:01 we made the decision to shut it down 15:04 and the only mechanism that we have in 15:06 place is to just stop 15:07 selling passes we got on the end of 15:09 lines instructed the people that were 15:11 coming up 15:12 uh that the piece of passes were no 15:14 longer to be sold after this point 15:16 um it didn't work out that great the 15:19 crowd arriving late in the day 15:22 as phil alluded to earlier was unruly 15:25 most had ill intentions and several of 15:28 our entrances in the center of town had 15:29 to be safeguarded by our police 15:31 department 15:33 so moving forward the city was very 15:37 upfront and clear 15:39 without plans to open the beaches 15:40 earlier this season 15:42 if there was a problem with people 15:44 playing by the rules or we needed to 15:46 revisit crowding and compliance issue 15:48 there was always going to be the 15:49 possibility that we would again restrict 15:52 access to residents only so as as phil 15:56 just said 15:57 effective this friday 16:00 residents may purchase beach passes 16:02 between the hours and 9 a.m and 4 p.m 16:04 seven days a week only at the trailer 16:07 located at 300 west broadway on the 16:09 corner on laurelton boulevard 16:12 non long non residents may purchase 16:14 daily beach passes monday through 16:16 thursday 16:17 at the same six locations that we've 16:19 been selling them at uh since the start 16:21 of the non-resident past sales long 16:23 beach road riverside boulevard edwards 16:25 boulevard 16:26 national boulevard magnolia and 16:28 laurelton 16:29 non-resident daily passes will be 16:31 punched the day they are purchased 16:34 there won't be advanced sales of passes 16:38 that can be used at later dates so you 16:40 buy a pass 16:41 you buy them one at a time it gets 16:43 punched for the day of purchase it's not 16:45 going to 16:45 not going to be able to stockpile passes 16:47 to use them over the weekends 16:51 uh moving further with the beach um 16:54 we just recently received permission 16:57 from the health department to reactivate 16:59 the showers on the beach 17:01 i had a conversation just a few minutes 17:02 ago with uh beach maintenance 17:04 superintendent tommy canner 17:06 uh he'll begin work immediately on the 17:08 lines and the fixtures 17:10 and probably have them all taken care of 17:12 and ready to go 17:14 within a week that's where we are at the 17:17 beach i would like to share 17:19 uh a text message that i got uh 17:21 yesterday morning 17:23 uh it was very nice good morning joe i 17:25 just wanted to let you know what a great 17:27 job the long beach lifeguards today 17:28 after hours on sunday night 17:30 myself and a couple of other guys were 17:32 on the beach and in the water once 17:34 two swimmers had gone into distress had 17:37 the lifeguards not shown up the outcome 17:38 could easily have been very different 17:40 those young men and women are fantastic 17:43 professional 17:44 and excellently trained they should be 17:46 thanks for their tremendous effort 17:48 i'm going to publicly thank them i know 17:51 donna and the castle have done so 17:53 uh over and over again but sunday night 17:56 the the water conditions turned 18:00 drastically in a real short period of 18:03 time 18:03 with the amount of people we had on the 18:05 beach sunday night 18:07 i'm not going to speak specifically but 18:08 i know there were upwards of 18:10 of 20 rescues life threatening rescues 18:14 after 6 p.m on sunday night that all 18:16 goes into this 18:17 decisions that that we all came up with 18:20 this week um 18:21 to scale things back a bit and kind of 18:23 take our beach back 18:24 and and get things uh normalcy restored 18:27 here 18:28 so that's where we're at guys 18:32 okay um still commissioner we're going 18:35 to film 18:35 golden needs to step back in for a 18:37 minute just say something 18:40 i meant to mention one 18:43 thing which is an important issue uh 18:46 we've seen a proliferation of the peach 18:50 passes 18:51 being passed off uh season pass holders 18:54 someone 18:54 having a bunch of them going back out to 18:57 the beach and and 18:58 it's occurred forever but i think it's 19:00 the magnitude that we haven't seen in 19:01 the past 19:02 so what we're doing now is really 19:06 truly intense beach sweeps we have a 19:08 special going beach to beach 19:10 and checking i'm from the west to the 19:13 east 19:13 uh certainly on the weekends all beach 19:16 passes 19:17 um and we're doing is when we see that 19:19 you don't have a pass 19:21 at this point we're trying to open up 19:23 the west end and center beaches 19:24 and east end beaches so we're we're 19:27 getting these people off the beach you 19:28 don't have a pass 19:29 uh some are getting summonses some are 19:31 being escorted off quickly 19:33 so we can open the beach again but the 19:35 sweeps is 19:36 the sweeps of the beaches are a priority 19:39 it's something we know has to be done 19:41 we see it as a big issue um and the 19:44 specials know it's a priority 19:46 to go out and go to all the different 19:48 groups especially 19:49 this beaches in the west end which are 19:51 real problems like minnesota or maryland 19:54 the center of town edwards east and west 19:57 and certainly 19:58 uh east and neptune east so we're we're 20:01 out there 20:02 they are focusing and concentrating on 20:05 going to the groups and making sure 20:06 everybody has a pass it's probably more 20:09 prevalent 20:10 now than i have ever seen and it 20:13 certainly is a priority 20:18 um thank you very much the only thing 20:21 that i have to add uh 20:22 to add to that um we have truly been 20:25 working hard 20:26 um we are currently putting together a 20:28 crisis team 20:30 here in long beach we have a crisis team 20:33 which is a psychologist and administer a 20:36 doctor 20:37 that comes out of nasa county but with 20:39 so many saves 20:41 and with um at times life loss 20:44 it's very important that our staff have 20:46 someone to talk to 20:48 right away um and so we are now 20:51 currently working 20:52 to get that crisis team put together 20:54 here in long beach so they 20:57 our response time is quicker for that 20:59 team to be put in place 21:01 and that's the end of my report 21:06 president bendo can i share with you my 21:08 kid 21:10 if you'd like sure i witnessed firsthand 21:14 the large crowds gathered on the beach 21:16 on saturday and sunday evenings 21:18 on both nights there were hundreds of 21:19 people on the beach with no social 21:21 distancing 21:22 in addition to the large crowds on 21:24 sunday evening 21:26 the lifeguards had to make numerous 21:28 rescues 21:29 i personally went down to the ocean on 21:31 sunday night around 7 30 p.m 21:34 to tell a group of swimmers how 21:36 dangerous it was to be in the ocean so 21:38 close to the jetties 21:39 and this was on new york air view at the 21:41 same time i noticed a helicopter 21:43 circling the beach around long beach 21:45 what i thought was long beach boulevard 21:47 when i arrived 21:49 at long beach road there were multiple 21:51 rescues going on 21:52 city manager donna gayden was on the 21:55 scene in a vehicle with chief gillespie 21:57 acting police commissioner a goner 22:01 as far as i understand it was at the 22:02 emergency room to check on one of the 22:04 swimmers 22:05 who required medical treatment all in 22:08 all 22:09 there were approximately or over 20 22:12 lifeguards 22:13 working after 6 pm multiple 22:16 police vehicles on the beach including 22:19 special police officers 22:21 therefore as a result i fully support 22:24 the decision to close the beach at 8pm 22:26 and the boardwalk at 9pm thank you 22:33 okay thanks mike uh just i guess it's an 22:36 interesting story that 22:37 might give people a little bit of an 22:39 indication of what 22:40 some of our first responders down on the 22:43 beach are dealing with after hours 22:45 um and on the weekends a 22:49 woman uh was going into the water 22:53 after the lifeguards were off duty there 22:56 were some 22:58 some of the lifeguards were still on the 23:00 beach they hadn't totally cleared off 23:01 yet 23:02 and they told her not to go into the 23:04 water 23:06 and the woman proceeded to 23:09 throw about every four-letter word there 23:11 was in the book at them 23:13 telling them it was none of their dan 23:15 business she could do whatever she 23:16 wanted 23:18 ten minutes later that woman had to be 23:20 rescued 23:21 because she would have drowned 23:25 so that's what these people are dealing 23:27 with and 23:28 um it's it's time to to bring 23:32 some semblance of order uh uh back just 23:35 uh i get it people are slap happy 23:37 they've been cooped up 23:39 uh everybody's uh tired of the the 23:42 the coronavirus stuff but uh uh 23:45 it's it's been getting a little out of 23:46 hand so 23:49 uh with that uh uh donna do we have any 23:53 other reports we need to get 23:55 or no not tonight 23:58 okay so with that i guess we can move on 24:01 to the agenda 24:03 okay item one's approval of minutes from 24:05 prior meeting of july 8th 2020. 24:07 item two is a resolution adopting the 24:09 city fund balance policy 24:13 okay um city manager anybody are you 24:17 going to speak on 24:19 uh anna's on the call 24:25 sure good evening i 24:29 would like to um answer any questions 24:33 that you might have 24:34 on the policy the fund balance policy 24:37 and the investment policy 24:39 um it's the 24:42 it's uh the goal of this administration 24:45 to 24:46 create a fiscal policies manual that 24:50 will contain 24:51 all the financial policies 24:54 of the city these two policies 24:58 will become the first two policies of 25:01 that manual 25:02 and uh we are also i'd like to mention 25:05 that we're also um 25:08 running our once we prepare the policies 25:12 we run them by 25:14 on the consultants of the cma so 25:17 they could um review 25:20 and share best practices with us and 25:23 give us some 25:24 suggestions on 25:28 whatever they see uh would be 25:31 a more um streamlined process as they 25:34 see a lot of different municipalities 25:37 and governments um and their policies 25:46 okay uh thank you ina uh are there any 25:48 questions from the council members 25:52 i did a quick comment and a question um 25:57 you know i'd like to thank you for 25:58 putting this together this is um this 26:00 and the investment policy is a great 26:02 start of something that should have been 26:03 done a long time ago 26:05 um i'd like to yeah i'd like to make 26:08 sure that 26:09 if possible these policies could be put 26:11 on the website somehow the city website 26:14 they are all of our policies once you 26:16 update them 26:18 um and on them they will be put on the 26:20 website 26:21 great and then i uh 26:24 i noticed um bullet uh five uh on the 26:27 replenishment 26:28 i just asked that you um it talks about 26:31 um the unassigned fund balance falling 26:34 below below a certain level 26:36 and how we have to try to keep it get it 26:38 higher 26:39 each year so um i hold you 26:42 responsible to make sure you keep us to 26:44 our word to follow that 26:46 that policy and to build that fund 26:48 balance again 26:49 so it doesn't disappear and that um 26:53 on the last point it says that it will 26:55 be reviewed on an 26:56 annual basis by the city council um i'd 26:59 like to 26:59 um sort of memorialize that 27:03 that that be in a january or a july 27:05 meeting so that we can actually have uh 27:07 some 27:07 impact on making sure that we um 27:11 we build up the fund balance again is 27:13 that possible 27:14 absolutely we'll make sure that it's on 27:17 a calendar for next 27:18 july um along with any other policies 27:23 that will be implemented and we'll need 27:25 an annual review 27:26 great thank you sure 27:30 um city controllers like this is mike 27:33 delorey 27:34 hi mike hi how are you thank you for all 27:36 your hard work 27:37 i'm just going to read in the fund 27:38 balance that it just says 27:40 both the office of the new york state 27:42 controller and the government finance 27:44 officers association 27:46 recommend that local governments 27:48 establish a policy to maintain 27:50 reasonable levels of unexpected you know 27:53 funds and 27:54 so on and so forth and this policy 27:58 is would be generally applied to all of 28:01 the funds such as like the water and 28:03 sewer 28:04 as well yes general water and sewer 28:09 all operating all operating funds okay 28:12 thank you 28:14 sure 28:18 okay so this is just the latest step uh 28:21 that's being taken again to get the the 28:24 house in order and uh 28:26 get things back operating smoothly and 28:30 and and in a more transparent manner so 28:34 um hearing no further questions that we 28:37 get 28:37 from the council did we get any 28:38 questions from the public on this 28:41 uh yes we got one question from roy 28:43 lester 28:44 uh an item number two you're addict and 28:47 presume that's adopting a city fund 28:49 balance policy with no numbers no 28:51 historical perspective 28:52 no percentages other than having to do 28:54 with the unassigned fund balance and 28:56 basically a complete lack of 28:57 transparency with regards to the amount 28:59 in this fund 29:00 now and historically and how they relate 29:02 to our budget our budget 29:04 prior to voting i think it's necessary 29:06 that those numbers be disclosed to the 29:08 public 29:09 um i have the response from hino when i 29:11 reached out to her earlier today so 29:13 i'll read that off um and if she wants 29:15 to add anything to it she can feel free 29:18 um with regard to 29:21 adopting a fund balance with no numbers 29:23 the policy that's being discussed 29:25 tonight 29:26 recommends a level of unassigned fund 29:27 balance of five percent 29:29 of the normal prior year expenditures 29:31 made from its general water and sewer 29:33 funds 29:34 um the number is obviously going to 29:35 change from year to year based on the 29:37 change prior year expenditures 29:39 made from those funds however the policy 29:41 will remain applicable and universal 29:43 from year to year 29:44 since it's expressed as a percentage um 29:48 it's really five years of the prior five 29:50 percent of five years of the 29:51 five percent of the prior year's 29:53 expenditure is how it is 29:55 um with respect to no historical 29:57 perspective 29:58 um this is a policy and it's based on 30:01 best practices and national standards 30:03 um by you know bodies that set them and 30:07 is always expressed as a percentage of 30:09 the prior year's expenditures so 30:12 um the historical perspective we're not 30:14 really sure how that applies 30:17 um lack of transparency with the amount 30:19 of the funds historically how low they 30:20 are relative to our budget 30:22 prior to the vote um the 30:25 fund balance i think it's been discussed 30:27 ex you know extensively especially 30:29 through the budget process but it's also 30:31 since we are just taking a percent 30:32 percentage of prior years expenditure 30:36 just take five percent of what the 30:37 audited financials are from the prior 30:39 year and you have your number 30:40 so it's just a simple calculation and um 30:44 those numbers are readily available and 30:47 novena wants to add anything to that i 30:50 do 30:50 also the audited financials are on the 30:52 website 31:00 i would just add that this the 31:02 institution of a policy is actually the 31:04 tool 31:05 by which the city council can hold the 31:07 administration accountable 31:08 so that we can actually fulfill our 31:10 fiduciary responsibilities 31:12 so um the policy is the is the roadmap 31:15 of how we're going to 31:17 stay within the guidelines and the five 31:18 percent is recommend is widely 31:20 recommended 31:21 by new york state and other 31:23 municipalities across the country 31:24 so this is exactly what we need 31:28 right now um as far as 31:31 i remember a lot of the information um 31:34 that city manager gayton and the 31:37 controller had put 31:39 forth it's been in multiple areas 31:42 and i could just recite off the top of 31:44 my head roughly i believe 31:46 80 to 85 million times 5 is roughly 4 31:50 million 31:50 and i believe that in this last fiscal 31:54 period we were below a million dollars 31:56 and probably much less and therefore 32:00 um we were starting off the year 32:03 way underfunded and it's not this is 32:07 this 32:08 this administration his goal is to get 32:11 policies like this 32:12 out there so we're all 32:15 understanding of what we need to do 32:18 thank you 32:23 okay uh were there any other questions 32:25 from the public 32:32 is the mcnally any more questions from 32:34 the public or was that it 32:35 sorry i was reading something that's it 32:37 okay uh so with that we can move on to 32:39 the next item 32:40 item three is a resolution adopting the 32:42 city investment policy 32:46 okay is that going to be that is also 32:47 ana you know okay 32:51 um um so basically the same story 32:56 um that uh precedes the fund balance 33:00 policy um investment policy 33:03 um directs the city controller 33:07 um how uh 33:10 and where to invest cities funds 33:14 uh once we're gonna have they go hand in 33:17 hand because we 33:18 um currently don't really have any 33:21 access 33:21 funds really subject to extensive 33:25 investment 33:26 activity but once uh 33:30 we follow our fund balance policy and 33:33 will accumulate funds to invest 33:38 it will become a very relevant and 33:41 necessary 33:42 roadmap to follow in 33:46 terms of investing cities money 33:49 and like it says it has to be 33:52 both prudent in terms of 33:56 taking reasonable level of risk 34:00 um as well as 34:03 appropriate in terms of looking for 34:07 a reasonable level of return 34:11 um that's about that 34:14 one more thing i want to add to that is 34:17 that 34:18 the city will be issuing an rfp um 34:21 its best practices station rfp 34:24 for banking services at least every five 34:27 years 34:28 so um i'm not aware of um 34:32 a banking rfp been issued in the 34:35 previous five years 34:36 i did my due diligence and um i know 34:39 that it hasn't been 34:41 so uh we're going to see an rfp for 34:44 banking 34:45 and once uh city council approves 34:48 banking 34:49 institutions that will select as a 34:51 result of that 34:52 um rfp um we will have to update this 34:56 investment policy 34:57 to include uh names of the 35:01 institutions into the policy 35:06 that's about that 35:09 okay are there any questions from the 35:11 council 35:13 yes i just have one question thank you 35:15 again for this policy ena 35:17 um this again will be reviewed annually 35:19 by the council i noted 35:21 and that um in section three it does 35:24 talk about 35:24 the fact that all employees directly 35:26 associated with the investment process 35:28 will be bonded yeah 35:30 i would like i would like to make sure 35:32 that the council is aware of that in the 35:33 annual review and to what amount each 35:35 employee is 35:36 bonded sure thank you 35:42 okay any other questions 35:47 all right i wanted to say about the 35:49 policies that we're putting forth 35:51 because you will be getting more 35:53 policies over the next probably two 35:55 months 35:55 um what we do is we we've identified all 35:58 the policies that 35:59 need to be updated um they're updated 36:02 in-house 36:03 they're they're reviewed in-house and 36:04 then they're sent to cma 36:06 cma reviews them and then we make sure 36:09 that they 36:09 are applicable to the government finance 36:12 or officers 36:13 association best practice policies 36:16 um and so that when 36:19 the policies are approved what you can 36:21 say is that we have the best practice 36:23 throughout the country 36:25 with the best policy that can be had at 36:27 that particular time 36:28 and so it's important that the public 36:30 knows that we just don't 36:32 put things down on paper and say this is 36:34 a good policy these policies are 36:36 vetted very well before we send them to 36:39 be voted on 36:44 okay um hearing no other questions from 36:47 the council did we get any questions 36:49 from the public 36:51 uh we got one question from mr lester 36:53 again so on number three you have stated 36:55 that you're revising and updating the 36:56 city's investment policy currently in 36:58 effect and you have given no information 37:00 on what the policy currently is in 37:03 effect and how you are now 37:04 changing it or the reasons for why it's 37:07 being changed please 37:08 state those reasons and the changes 37:10 prior to voting on this 37:11 um so ena gave a little bit of an answer 37:13 i don't know if to want to expound upon 37:14 it again 37:15 it stated in the body of the original 37:17 policy which was last revised in 2015 37:19 that 37:20 on an annual basis the city shall review 37:22 the investment policy 37:23 and shall approve policy revisions if 37:25 any by formal resolution 37:27 so that's why it's here i don't know if 37:29 she wants to 37:30 um talk a little bit about you know the 37:33 changes that were made or not 37:36 sure um so so basically there is no 37:40 um our policies as donald just mentioned 37:43 they have to follow general municipal 37:46 law 37:47 and whatever standard the 37:50 governing accounting bodies um 37:53 [Music] 37:55 sad for for the government so 37:58 unless there is a major change in those 38:02 governing documents 38:05 and laws we are not going to see 38:10 a major change in the investment policy 38:12 and something like 38:13 investment policy so the 38:16 kind of type of securities that are 38:19 prescribed 38:21 um that we can 38:24 um as a government um engage 38:27 in uh investing in is not something that 38:31 that 38:32 we actually um come up with um 38:35 it's something those classes of um 38:38 those classes of securities they 38:42 um it's something that's a lot load 38:45 allowed to us by law so 38:48 and um like i mentioned in my previous 38:51 uh 38:51 in my answer written answer to john um 38:55 this is a policy like that 38:58 an investment policy has to be reviewed 39:01 every year 39:02 and exactly for that reason that it has 39:05 to follow the law 39:07 so we basically make sure that we 39:10 if there if there are any changes in the 39:12 law 39:13 that affect the change in policy it will 39:16 be 39:16 presented in in the new revised version 39:21 there was no drastic changes in the law 39:24 so 39:25 while we made the changes and you will 39:27 see the most major one you will see is 39:29 the one that talks about the 39:31 institutions with which the city is 39:34 allowed to deal with and that's what i 39:36 when i talk about the rfp and the 39:39 banking 39:40 services that will be selected in the 39:43 next couple of months 39:48 that's done okay 39:51 thank you uh were there any other 39:54 i 40:32 believe 40:33 one of the beach chairs has been asked 40:36 to 40:36 be put at neptune because they're in 40:39 honor of 40:40 their mother and that is the beach that 40:43 she enjoyed 40:44 that so we had to remove the 44:56 wall so 44:57 this covered about uh 12 different 44:59 change orders within the contract 45:01 uh we only issued the purchase order for 45:04 a certain amount 45:05 so we needed to uh uh increase the 45:08 purchase order 45:09 uh by 144 thousand dollars uh this 45:13 purchase these change orders were 45:14 approved by the governor's office of 45:16 storm recovery already 45:17 the money is available from the 45:19 governor's office of storm recovery 45:21 so by just approving this it allows us 45:23 to then pass this money on to the 45:30 contractor okay 45:32 um any questions from the council 45:36 has the contractor completed the work 45:38 yes the oem is complete 45:40 including the testing of the generator 45:42 and uh just 45:43 a few things that we're response and recovery 47:43 consulting services 47:48 and i'm going to guess this is john 47:50 again correct 47:52 so uh over two years ago we have 11 47:56 as i reviewed the other night at the 47:57 work session we have 11 hazard 47:59 mitigation projects 48:00 that are being funded by fema so 48:04 a little over two years ago we issued uh 48:08 an rfp and we awarded to three different 48:10 engineering firms three engineering 48:12 consulting firms 48:13 the work to split up uh based on the 48:16 areas of their expertise and that was uh 48:18 cameron engineering l.k mclean and de 48:22 virgo and bottomluci 48:23 uh those projects are at various stages 48:27 of completion 48:28 some are in the design stage some are 48:30 ready to go out to bid 48:32 but the uh agreement we have with the 48:35 engineers expired 48:36 in april uh so what we need to do is 48:39 extend those contracts it doesn't make 48:41 any sense to do another rfp 48:43 and go out for engineers because you 48:45 wouldn't want to they'd have to go back 48:46 to square one and start 48:48 over these projects so i had mentioned 48:50 this the other night that we would be 48:52 presenting this to uh for approval so 48:54 that we can continue to work 48:55 it these projects take a little longer 48:57 to do uh just to give you an example we 49:00 had a 49:02 million-dollar hazard mitigation project 49:04 for the first floor city hall 49:06 we had the plans all done and then the 49:09 state office historic preservation came 49:11 out with a 49:13 a mandate saying that this building was 49:16 of historical significance 49:18 and we needed to do a report for shippo 49:20 and so we had to have the consultant do 49:22 that report 49:23 or we could move on with the final 49:25 design and based on that report 49:27 we're waiting to hear from shippo now 49:29 changes we have to make to the original 49:31 design 49:32 so it's the kind of things that go back 49:33 and forth and there's a you know a lot 49:35 of back and forth with fema 49:36 and also with the department of homeland 49:38 security on these projects so 49:40 they're taking longer to get done than 49:42 we anticipated when we first awarded 49:44 these uh contracts to these three firms 49:46 uh so 49:47 we think it's in the best interest of 49:48 the city to just extend those contracts 49:50 at this point 49:51 uh so that we don't lose more time 49:55 okay and if these are projects that are 49:59 being funded by 50:00 fema or whoever uh does the 50:04 the renewal uh usually get picked up the 50:07 cost 50:07 uh as part of the project correct yes 50:10 they pay for all the engineering costs 50:12 in addition to that as i mentioned the 50:13 other night 50:14 they also pay for our staff's course 50:16 when we're involved
